Hadith 2329

أَخْبَرَنَا عَمْرُو بْنُ عَوْنٍ، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ خَالِدٍ يَعْنِي الْحَذَّاءَ عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ: أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا يُقَالُ لَهُ: مُغِيثٌ، كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلْعَبَّاسِ: "يَا عَبَّاسُ، أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ، وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا ؟"فَقَالَ لَهَا: "لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ"، فَقَالَتْ: يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي ؟ قَال: "إِنَّمَا أَنَا شَافِعٌ"، قَالَتْ: لَا حَاجَةَ لِي فِيهِ.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrated that Sayyidah Barirah’s (may Allah be pleased with her) husband was a slave whose name was Mughith. It is as if I am seeing him circumambulating behind Sayyidah Barirah (may Allah be pleased with her), and his beard is wet with tears. The Noble Prophet (peace and blessings be upon him) said to Sayyiduna Abbas (may Allah be pleased with him): “O Abbas! Do you not find it astonishing how much Mughith loves Barirah and how much Barirah dislikes Mughith?” The Messenger of Allah (peace and blessings be upon him) said to Sayyidah Barirah (may Allah be pleased with her): “Consider your decision, for he is the father of your child.” Sayyidah Barirah (may Allah be pleased with her) said: O Messenger of Allah (peace and blessings be upon him)! Is this your command? He replied: “No, I am only interceding.” Sayyidah Barirah (may Allah be pleased with her) said: Then (there is no need for me to reconsider), and I do not want Mughith.

Brief Explanation
(Commentary on Hadiths 2327 to 2329)

From all these narrations, it is established that if the husband of a slave woman is himself a slave, then after she attains freedom, she has the choice: if she wishes, she may remain with her husband, and if she wishes, she may choose separation. Here, the intelligence and wisdom of Sayyidah Barirah radi Allahu anha also becomes evident; she asked, “If this is your command, then it is upon my head and eyes (i.e., I will obey without question).” Likewise, the compassion of the Messenger of Allah sallallahu alayhi wa sallam and his detachment from personal inclination or emotional bias in explaining the Shari‘ah is also apparent, when he said, “No, according to the Shari‘ah, the choice is yours, but my recommendation is that you do not disappoint Mughith.”
«فداه أبى وأمي وصلى اللّٰه على نبينا محمد وعلى آله وصحبه أجمعين ومن تبعهم باحسان إلى يوم الدين.»
