أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الرَّقَاشِيُّ، حَدَّثَنِي مَالِكٌ، قَالَ: سَمِعْتُ نَافِعًا، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، قَالَ: "فَرَّقَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَ الْمُتَلَاعِنَيْنِ، وَأَلْحَقَ الْوَلَدَ بِأُمِّهِ".
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said that the Messenger of Allah (peace and blessings be upon him) separated the husband and wife who engaged in li'an, and gave the child to his mother.
Brief Explanation
(Commentary on Hadith 2268)
From this hadith, it is understood that if a man accuses his wife of adultery, then after the process of li'an (mutual cursing), separation will take place between them. And if a child is born, he will be handed over to the mother; he will not be attributed to the father. He will inherit from his mother, not from his father.
