Hadith 2268

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، أَخْبَرَنَا عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ، قَالَ: سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ، يَقُولُ: "سُئِلْتُ عَنِ الْمُتَلَاعِنَيْنِ فِي إِمَارَةِ مُصْعَبِ بْنِ الزُّبَيْرِ: أَيُفَرَّقُ بَيْنَهُمَا ؟ فَمَا دَرَيْتُ مَا أَقُولُ، قَالَ: فَقُمْتُ حَتَّى أَتَيْتُ مَنْزِلَ عَبْدِ اللَّهِ بْنِ عُمَرَ، فَقُلْتُ لِلْغُلَامِ: اسْتَأْذِنْ لِي عَلَيْهِ، فَقَالَ: إِنَّهُ قَائِلٌ لَا تَسْتَطِيعُ أَنْ تَدْخُلَ عَلَيْهِ، قَالَ: فَسَمِعَ ابْنُ عُمَرَ صَوْتِي، فَقَالَ: ابْنُ جُبَيْرٍ ؟، فَقُلْتُ: نَعَمْ، فَقَالَ: ادْخُلْ، فَمَا جَاءَ بِكَ هَذِهِ السَّاعَةَ إِلَّا حَاجَةٌ، قَالَ: فَدَخَلْتُ عَلَيْهِ فَوَجَدْتُهُ وَهُوَ مُفْتَرِشٌ بَرْذَعَةَ رَحْلِهِ، مُتَوَسِّدٌ مِرْفَقَةُ أَوْ قَالَ: نُمْرُقَةً، شَكَّ عَبْدُ اللَّهِ حَشْوُهَا لِيفٌ، فَقُلْتُ: يَا أَبَا عَبْدِ الرَّحْمَنِ: الْمُتَلَاعِنَانِ، أَيُفَرَّقُ بَيْنَهُمَا ؟ . قَالَ: سُبْحَانَ اللَّهِ، نَعَمْ، إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانٌ، فَقَالَ: يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْكَ، أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ ؟ إِنْ سَكَتَ، سَكَتَ عَلَى أَمْرٍ عَظِيمٍ، وَإِنْ تَكَلَّمَ فَمِثْلُ ذَلِكَ ؟، قَالَ: فَسَكَتَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يُجِبْهُ، فَقَامَ لِحَاجَتِهِ، فَلَمَّا كَانَ بَعْدَ ذَلِكَ، أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: يَا رَسُولَ اللَّهِ، إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدْ ابْتُلِيتُ بِهِ، قَالَ: فَأَنْزَلَ اللَّهُ تَعَالَى هَؤُلَاءِ الْآيَاتِ الَّتِي فِي سُورَةِ النُّورِ: وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلا أَنْفُسُهُمْ فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الصَّادِقِينَ { 6 } وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ { 7 } وَيَدْرَأُ عَنْهَا الْعَذَابَ أَنْ تَشْهَدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ { 8 } وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ { 9 } سورة النور آية 6-9 حَتَّى خَتَمَ هَؤُلَاءِ الْآيَاتِ، قَالَ: فَدَعَا الرَّجُلَ، فَتَلَاهُنَّ عَلَيْهِ، وَذَكَّرَهُ بِاللَّهِ، وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ، فَقَالَ: مَا كَذَبْتُ عَلَيْهَا، . ثُمَّ دَعَا الْمَرَأَةَ فَوَعَظَهَا وَذَكَّرَهَا، وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ، فَقَالَتْ: وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ، فَدَعَا الرَّجُلَ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنْ الصَّادِقِينَ، وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ، ثُمَّ أُتِيَ بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ، ثُمَّ فَرَّقَ بَيْنَهُمَا".
Abdul Malik bin Abi Sulaiman said: I heard from Saeed bin Jubair, may Allah have mercy on him, that he said: During the governorship of Mus'ab bin Zubair, I was asked about those who perform li'an: Should separation be made between them? I was surprised as to what answer I should give, so I went to the house of Abdullah bin Umar, may Allah be pleased with them both, and said to the servant: Get me permission to enter. He said: At this time he is resting and you cannot go inside. Saeed said: Ibn Umar, may Allah be pleased with them both, heard my voice and said: Is it Ibn Jubair? I said: Yes. He said: Come in, surely you have come for some important matter at this time. I entered and saw that he was sitting on a spread blanket and leaning with his hand on a pillow filled with date palm fibers. I said: O Abu Abdur Rahman! Should separation be made between those who perform li'an? Ibn Umar, may Allah be pleased with them both, said: Glory be to Allah, indeed separation will be made, and the first to ask about this was so-and-so son of so-and-so. He said: O Messenger of Allah! May Allah's mercy be upon you, tell me, if a man sees his wife committing adultery, what should he do? If he remains silent, how can he remain silent over such a grave matter, and if he speaks, he will utter something terrible. Ibn Umar, may Allah be pleased with them both, said: The Messenger of Allah, peace and blessings be upon him, remained silent and did not give him any answer, then he got up for some need of his. Then (one day) that man came to the Prophet, peace and blessings be upon him, and said: I have been afflicted with the very matter I asked you about. Then Allah the Exalted revealed these verses of Surah An-Nur: «﴿وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ ......﴾» [نور: 6/24-11] The Prophet, peace and blessings be upon him, recited these verses and finished, then called that man and recited them to him, and advised him, reminded him of Allah, and said: "Behold, the punishment of this world is easier than the punishment of the Hereafter (meaning, if he is falsely accusing his wife, let him admit it, for only the prescribed punishment of slander, eighty lashes, will be given, but that is easier than burning in Hell)." He said: No, I have not lied. Then the Prophet, peace and blessings be upon him, called his wife and warned and advised her, and said: "The punishment of this world is easier than the punishment of the Hereafter." She said: By Him Who sent you with the truth, my husband is lying. So the Prophet, peace and blessings be upon him, called the man, and he testified four times by Allah that he was truthful, and the fifth time he said: May the curse of Allah be upon him if he is lying. Then the Prophet, peace and blessings be upon him, called the woman, and she testified four times by Allah that he was lying, and the fifth time she said: If he is truthful, then may the wrath of Allah be upon her. Then the Prophet, peace and blessings be upon him, separated the two of them.
