Hadith 2234

حَدَّثَنَا مُحَمَّدٌ حَدَّثَنِي ابْنُ عُيَيْنَةَ، عَنْ الزُّهْرِيِّ، عَنْ الْحَسَنِ، وَعَبْدِ اللَّهِ، عَنْ أَبِيهِمَا، قَالَ: سَمِعْتُ عَلِيًّا , يَقُولُ لِابْنِ عَبَّاسٍ: "إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُتْعَةِ: مُتْعَةِ النِّسَاءِ، وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ عَامَ خَيْبَرَ".
Sayyiduna Ali (may Allah be pleased with him) said to Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) forbade temporary marriage with women and the eating of domesticated donkey meat in the year of Khaybar.

Brief Explanation
(Explanation of Hadiths 2231 to 2234)

Mut‘ah refers to marrying a woman for a specified period of time; when the appointed time is completed, separation between them occurs automatically.

To contract marriage in this manner is now forbidden until the Day of Judgment; there is consensus (ijma‘) of all Imams, scholars, and jurists on this, except for a few Rawafid (Rafidites).

Regarding when mut‘ah was prohibited, there are differing opinions due to various narrations. In the first hadith, it is stated that its absolute prohibition was announced during the Farewell Pilgrimage (Hajjat al-Wada‘); the hadith is authentic, but the narrator was mistaken.

In the second hadith, it is mentioned that it was declared unlawful at the conquest of Makkah in 8 AH; this is more correct.

In the third narration, the year of Khaybar, 7 AH, is mentioned, and this narration is also authentic and agreed upon. Therefore, the scholars have said that the prohibition and permission of mut‘ah occurred twice, i.e., on the days of Khaybar and the conquest of Makkah.

Hafiz Ibn al-Qayyim rahimahullah and others have established with strong proofs that the prohibition occurred only once, at the conquest of Makkah; before that, mut‘ah was permissible, as is evident from the statement of Allah, the Exalted: «﴿فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ فَآتُوهُنَّ أُجُورَهُنَّ﴾ [النساء: 24]». And now, by the consensus of the Ummah, it is forbidden until the Day of Judgment to marry a woman for a fixed period.

From this hadith, it is also understood that the meat of domesticated donkeys is also forbidden, which was undoubtedly prohibited during the Battle of Khaybar.
