Hadith 2229

أَخْبَرَنَا خَالِدُ بْنُ مَخْلَدٍ، حَدَّثَنَا مَالِكٌ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ، عَنْ عَبْدِ الرَّحْمَنِ، وُمُجَمِّعٍ ابْنَيْ يَزِيدَ بْنِ جَارِيَةَ، أَنَّ خَنْسَاءَ بِنْتَ خِذَامٍ زَوَّجَهَا أَبُوهَا وَهِيَ ثَيِّبٌ، فَكَرِهَتْ ذَلِكَ، فَأَتَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ "فَرَدَّ نِكَاحَهَا".
It is narrated from the two sons of Yazid bin Jariyah, Abdur Rahman and Majma', that Sayyidah Khansa bint Khidham (may Allah be pleased with her) was married off by her father while she was previously married (i.e., not a virgin), and she did not approve of this marriage. So she came to the Messenger of Allah (peace and blessings be upon him), and he annulled this marriage.

Brief Explanation

From both of these narrations, it is understood that a father cannot force his daughter into marriage, and if the father does marry her off against her wishes, then upon the girl's request, that marriage will be annulled, whether the girl is previously married (thayyib) or a virgin (bikr). And in the narrations of Imam Ahmad and Imam Abu Dawud rahimahum Allah and others, it is mentioned that a father married his virgin (bikr) daughter against her will, so the Messenger of Allah sallallahu alayhi wa sallam gave her the choice: if she wished, she could maintain the marriage, and if she wished, she could have it annulled.

Imam Bukhari rahimahullah has also indicated the same, but in the first hadith, only the thayyib is mentioned, so some scholars have said that only a thayyib is given the option to have the marriage annulled. However, the statement of Imam Bukhari rahimahullah is more correct, because in the hadiths, both thayyib and bikr are mentioned.
