Hadith 2215

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ، حَدَّثَنَا دَاوُدُ يَعْنِي ابْنَ أَبِي هِنْدٍ، حَدَّثَنَا عَامِرٌ، حَدَّثَنَا أَبُو هُرَيْرَةَ: "أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا، وَالْعَمَّةُ عَلَى ابْنَةِ أَخِيهَا، أَوْ الْمَرْأَةُ عَلَى خَالَتِهَا، أَوْ الْخَالَةُ عَلَى بِنْتِ أُخْتِهَا، وَلَا تُنْكَحُ الصُّغْرَى عَلَى الْكُبْرَى، وَلَا الْكُبْرَى عَلَى الصُّغْرَى".
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings be upon him) forbade marrying a woman and her paternal niece together, or a niece and her paternal aunt together; likewise, marrying a woman and her maternal niece together, or a niece and her maternal aunt together. Neither should the elder be married along with the younger, nor the younger along with the elder.
Brief Explanation
(Commentary on Hadith 2214)
That is, if someone has married a woman’s niece (brother’s daughter), then during her lifetime he should not marry her paternal aunt; and if he has married the niece (sister’s daughter), then it is not permissible for him to marry her maternal aunt; and if he has married the paternal aunt, then he should not marry her niece (brother’s daughter); and similarly, if he has married the maternal aunt, then he should not marry the niece (sister’s daughter).
