Hadith 2142

حَدَّثَنَا عَاصِمُ بْنُ عَلِيٍّ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنْ الْحَارِثِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "إِذَا سَكِرَ، فَاجْلِدُوهُ، ثُمَّ إِذَا سَكِرَ، فَاجْلِدُوهُ، ثُمَّ إِذَا سَكِرَ، فَاجْلِدُوهُ، ثُمَّ إِذَا سَكِرَ، فَاضْرِبُوا عُنُقَهُ" . يَعْنِي فِي الرَّابِعَةِ.
Sayyiduna Abu Hurairah (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings of Allah be upon him) said: "When someone becomes intoxicated, flog him. Then if he does it again, flog him. Then if he drinks alcohol, flog him. If he drinks alcohol a fourth time, then kill him."

Brief Explanation
(Commentary on Hadith 2141)

Despite the authenticity of this hadith, the four Imams and the Ahl al-Hadith have considered it abrogated, due to that hadith in which it is stated that a Muslim can only be killed for three reasons: adultery, retribution (qisas), or apostasy. Furthermore, during the time of the Prophet sallallahu alayhi wa sallam, there were several occasions when individuals who had consumed alcohol for the fourth time were brought before him, and he sallallahu alayhi wa sallam did not have them killed. Therefore, this statement and action have abrogated the aforementioned hadith. Thus, one who drinks alcohol more than three times will be flogged, but not killed.
