Hadith 2141

حَدَّثَنَا مُحَمَّدُ بْنُ أَحْمَدَ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرٍو يَعْنِي: ابْنَ دِينَارٍ، عَنْ طَاوُسٍ، عَنْ ابْنِ عَبَّاسٍ، قَالَ: بَلَغَ عُمَرَ أَنَّ سَمُرَةَ بَاعَ خَمْرًا، فَقَالَ: قَاتَلَ اللَّهُ سَمُرَةَ، أَمَا عَلِمَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: "لَعَنَ اللَّهُ الْيَهُودَ، حُرِّمَتْ عَلَيْهِمْ الشُّحُومُ فَجَمَلُوهَا، فَبَاعُوهَا" . قَالَ سُفْيَانُ: جَمَلُوهَا: أَذَابُوهَا.
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said that Sayyiduna Umar (may Allah be pleased with him) received news that Sayyiduna Samurah (may Allah be pleased with him) had sold wine, so he said: May Allah destroy Samurah! Does he not know that the Noble Prophet (peace and blessings be upon him) said: “May Allah curse the Jews; fat was made unlawful for them, but they melted it and sold it.” Sufyan said: The meaning of «جملوها» is «اذابوها» .

Brief Explanation
(Commentary on Ahadith 2139 to 2141)

Allamah Waheeduz-Zaman rahimahullah has written under this hadith: Its meaning is that they sold that fat and consumed its price. From this, it is understood that just as wine (khamr) is forbidden (haram), likewise taking its price and trading in it is also forbidden. It is regrettable that in our times, some Muslim traders keep wine in their shops and think that selling wine is not as sinful as drinking it, whereas according to the hadith, all are equal and the curse (la'nah) has come upon all, and the money from wine is haram. Consuming it and feeding it to others are both not permissible. Similarly, money from usury (riba), and attending the invitation of a trader who deals in wine and usury, is against piety (taqwa).

In Bukhari and other collections, it is not mentioned that Sayyiduna Samurah radi Allahu anhu sold wine; it is the mention of a common person. In any case, from this hadith, one can gauge the zeal and honor of Sayyiduna Umar radi Allahu anhu, that he absolutely could not tolerate anything contrary to the Shari'ah.

And it is also understood that to use explicitly forbidden things (muharramat mansusah) through legal trickery (hiyal) is the action of the Jews, upon whom Allah Ta'ala's curse is.

Therefore, one should avoid such actions.
