Hadith 2104

أَخْبَرَنَا سَعِيدُ بْنُ سُلَيْمَانَ، عَنْ سُلَيْمَانَ بْنِ الْمُغِيرَةِ، عَنْ ثَابِتٍ، عَنْ أَنَسٍ، قَالَ: جَاءَ رَجُلٌ قَدْ صَنَعَ طَعَامًا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: يَا رَسُولَ اللَّهِ، هَكَذَا وَأَوْمَأَ إِلَيْهِ بِيَدِهِ، قَالَ: يَقُولُ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: هَكَذَا، وَأَشَارَ إِلَى عَائِشَةَ، قَالَ: لَا، فَأَعْرَضَ عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَوْمَأَ إِلَيْهِ الثَّانِيَةَ: وَأَوْمَأَ إِلَيْهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَعْرَضَ عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَوْمَأَ إِلَيْهِ الثَّالِثَةَ، فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "وَهَذِهِ ؟"قَالَ: نَعَمْ، فَانْطَلَقَ مَعَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَعَائِشَةُ فَأَكَلَا مِنْ طَعَامِهِ".
It is narrated from Sayyiduna Anas (may Allah be pleased with him) that a man prepared food and came to the service of the Messenger of Allah (peace and blessings be upon him). With a gesture of his hand, he submitted: O Messenger of Allah! Please come for food. The Messenger of Allah (peace and blessings be upon him) also gestured towards Sayyidah Aisha (may Allah be pleased with her), asking: Will she come with me? He said: (There is not enough space). The Messenger of Allah (peace and blessings be upon him) turned his attention away from him. He again gestured to invite the Prophet (peace and blessings be upon him), and the Prophet again gestured towards Sayyidah Aisha (may Allah be pleased with her). He gave the same reply, so the Messenger of Allah (peace and blessings be upon him) again turned his attention away from him. That man, for the third time, gestured to the Messenger of Allah (peace and blessings be upon him) to come, so the Prophet again gestured towards Sayyidah Aisha (may Allah be pleased with her). Then he said: Take her along as well. Thus, the Messenger of Allah (peace and blessings be upon him) and Sayyidah Aisha (may Allah be pleased with her) both went with him and ate from his spread.

Brief Explanation
(Commentary on Hadith 2103)

Imam Nawawi rahimahullah said that the Messenger of Allah sallallahu alayhi wa sallam did not accept the invitation of this Persian neighbor because Sayyidah Aisha radi Allahu anha was also hungry, and this is the highest example of good companionship—that he did not like to partake of an invitation alone. And when that person permitted the Mother of the Believers to accompany him, then the Prophet sallallahu alayhi wa sallam accepted the invitation. Accepting an invitation is obligatory. The scholars have written several reasons for the Messenger of Allah sallallahu alayhi wa sallam not accepting the invitation:

One is that the Messenger of Allah sallallahu alayhi wa sallam had the choice to accept or not accept an invitation.

Second is that only accepting the invitation of a wedding feast (walimah) is obligatory, and accepting any other invitation is not obligatory (and Allah knows best).

From this hadith, it is also understood that communication and action can be done through gestures, and this is recognized in the Shariah—even if a gesture is made for divorce, the divorce will take effect.

For this reason, Imam Nasa'i rahimahullah has mentioned this hadith in the Book of Divorce (Kitab al-Talaq).
