Hadith 2042

أَخْبَرَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا زَكَرِيَّا، عَنْ عَامِرٍ، عَنْ عَدِيِّ بْنِ حَاتِمٍ، قَالَ: سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ صَيْدِ الْمِعْرَاضِ، فَذَكَرَ مِثْلَهُ.
Sayyiduna ‘Adi bin Hatim (may Allah be pleased with him) said: I asked the Messenger of Allah (peace and blessings be upon him) about hunting with a broad object (such as an arrow without a feather, a stick, a staff, etc., which has no blade), so ... he narrated similarly.

Brief Explanation
(Commentary on Ahadith 2040 to 2042)

In the narration of Sahih Bukhari, it is explicitly stated that if the point of the mi‘rad (a hunting tool with a pointed end) strikes the game, then eat it; but if the game is struck by its broad (flat) side, then do not eat it, because it is mauqūdh (killed by a blow, not by a sharp edge). And in Ibn Majah, it is stated: “Whatever dies by its point, eat it; and whatever dies by its broad side is carrion,” (because it is like an animal killed by a stick or a stone, which is considered dead meat). Further explanation is coming ahead in the fourth chapter.

In Islamic Shari‘ah, hunting land and air animals for the purpose of eating is permissible. Whether this hunting is done with a gun, slingshot, stick, or net, or with the help of a trained falcon, dog, eagle, etc., all are permissible. However, there are certain conditions: the most important is that the name of Allah (Bismillah) should be pronounced at the time of hunting, and if there is an opportunity to perform ritual slaughter (dhabh), then that game is undoubtedly lawful (halal). When releasing the dog or falcon, the name of Allah should also be pronounced, and if they only catch the game, then after slaughtering it, it can be eaten. The condition is that it must be a kalb mu‘allam, i.e., a trained and taught dog, as the Divine Word says: «﴿وَمَا عَلَّمْتُمْ مِنَ الْجَوَارِحِ مُكَلِّبِينَ تُعَلِّمُونَهُنَّ مِمَّا عَلَّمَكُمُ اللّٰهُ فَكُلُوا مِمَّا أَمْسَكْنَ عَلَيْكُمْ وَاذْكُرُوا اسْمَ اللّٰهِ عَلَيْهِ .....﴾ [المائده : 4]» Translation: “And those hunting animals which you have trained—so eat of what they catch for you, and mention the name of Allah over it...”

From this verse and the aforementioned hadith, it is understood that if the dog or falcon eats from the game, then it is not lawful and permissible. It is also understood that if the dog’s mouth or saliva touches the game, there is no objection to eating it, because this is a special and exceptional permission from Allah Ta‘ala. Furthermore, it is also established from the mentioned hadith that if one’s own dog and another’s dog both participate in the hunt and the game dies, then it is haram.

Also, if a Muslim pronounces Bismillah when releasing a trained dog (kalb mu‘allam) and the game dies, then according to the majority of scholars, it is lawful (halal).
