Hadith 1976

أَخْبَرَنَا إِسْحَاق، حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا إِسْرَائِيلُ، عَنْ إِبْرَاهِيمَ بْنِ مُهَاجِرٍ، عَنْ يُوسُفَ بْنِ مَاهَكَ، عَنْ أُمِّهِ مُسَيْكَةَ وَأَثْنَى عَلَيْهَا خَيْرًا، عَنْ عَائِشَةَ، قَالَتْ: قُلْتُ: يَا رَسُولَ اللَّهِ، أَلَا نَبْنِي لَكَ بِمِنًى بِنَاءً يُظِلُّكَ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "لَا، مِنًى مُنَاخُ مَنْ سَبَقَ".
Lady Aisha (may Allah be pleased with her) said, I asked: O Messenger of Allah! Shall we build a shaded structure for you in Mina? The Messenger of Allah (peace be upon him) said: "No, in Mina, whoever arrives first, that is his place."

Brief Explanation
(Commentary on Hadith 1975)

That is, the plain of Mina is endowed (waqf) for the pilgrims; it is not the property of any particular individual. Whoever arrives first and settles at a place, another person cannot displace him from there. By constructing a shelter, one establishes possession and right over a spot, so that another cannot settle there. Therefore, the Prophet sallallahu alayhi wa sallam did not permit this.
