Hadith 1946

أَخْبَرَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، حَدَّثَنَا الزُّهْرِيُّ، عَنْ عِيسَى بْنِ طَلْحَةَ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَقَفَ لِلنَّاسِ فِي حَجَّةِ الْوَدَاعِ، فَقَالَ لَهُ رَجُلٌ: يَا رَسُولَ اللَّهِ، حَلَقْتُ قَبْلَ أَنْ أَذْبَحَ؟ قَالَ: "لَا حَرَجَ" . قَالَ: لَمْ أَشْعُرْ، ذَبَحْتُ قَبْلَ أَنْ أَرْمِيَ؟ قَالَ: "لَا حَرَجَ" . فَلَمْ يُسْأَلْ يَوْمَئِذٍ عَنْ شَيْءٍ قُدِّمَ أَوْ أُخِّرَ إِلَّا قَالَ: "لَا حَرَجَ". قَالَ عَبْد اللَّهِ: أَنَا أَقُولُ بِهَذَا، وَأَهْلُ الْكُوفَةِ يُشَدِّدُونَ ..
Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said: The Messenger of Allah (peace and blessings be upon him) was standing (to answer questions) during the Farewell Pilgrimage when a man said: O Messenger of Allah! I shaved my head before sacrificing? He said: "There is no harm." Another said: I did not know and I performed the sacrifice before stoning? He said: "There is nothing wrong." Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said: On that day, for whatever matter he was asked about in which there was precedence or delay, the Prophet (peace and blessings be upon him) replied the same: "«لا حرج»" (There is no harm). Imam Darimi (may Allah have mercy on him) said: I also hold this view, but the people of Kufa are strict about this.

Brief Explanation
(Commentary on Hadiths 1944 to 1946)

On the tenth of Dhul-Hijjah, the pilgrim has to perform four acts: stoning (rami), sacrifice (qurbani), shaving or shortening of the hair (halq or taqsir), and the circumambulation of visitation (tawaf al-ziyarah). These rites are best performed in this order; however, if there is precedence or delay, there is no harm. There is no sin nor any expiation (fidya) required for performing these four rites out of order. This is the view of the Ahl al-Hadith, the Shafi‘is, and the Hanbalis. According to the Hanafis and the Malikis, the order is obligatory, and if it is not observed, a compensatory sacrifice (dam) becomes necessary. However, the statement of these scholars is not worthy of consideration because it is contrary to this hadith.

Do not look at anyone else's statement or action.

Imam Darimi rahimahullah has mentioned the people of Kufa; by this is meant the Hanafis, who, by making dam obligatory, adopt severity and harshness.
