Hadith 1873

حَدَّثَنَا مُسَدَّدٌ، أَخْبَرَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى بْنِ أَبِي إِسْحَاق، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، حَدَّثَنِي الْفَضْلُ بْنُ عَبَّاسٍ أَوْ عُبَيْدُ اللَّهِ بْنُ الْعَبَّاسِ، أَنَّ رَجُلًا قَالَ: يَا رَسُولَ اللَّهِ، إِنَّ أَبِي أَوْ أُمِّي عَجُوزٌ كَبِيرٌ، إِنْ أَنَا حَمَلْتُهَا لَمْ تَسْتَمْسِكْ، وَإِنْ رَبَطْتُهَا، خَشِيتُ أَنْ أَقْتُلَهَا . قَالَ: "أَرَأَيْتَ إِنْ كَانَ عَلَى أَبِيكَ أَوْ أُمِّكَ دَيْنٌ، أَكُنْتَ تَقْضِيهِ ؟". قَالَ: نَعَمْ، قَالَ: "فَحُجَّ عَنْ أَبِيكَ، أَوْ أُمِّكَ".
Sayyiduna Fadl bin Abbas or Sayyiduna Ubaidullah bin Abbas (may Allah be pleased with them) narrated that a man said, "O Messenger of Allah! My mother or father is old; if I make them ride (for Hajj), they will not be able to sit properly, and if I tie them to the mount, I fear they may die." The Prophet (peace and blessings be upon him) said, "What do you think, if your father or mother had a debt, would you pay off their debt?" He replied, "Yes, I would certainly pay it off." The Prophet said, "Then perform Hajj on behalf of your father or mother."

Brief Explanation

From these hadiths, the permissibility of performing the obligatory Hajj on behalf of one’s parents is established, whether they are alive or not, whether they have made a bequest (wasiyyah) or not. Their son or daughter, if the parents are unable to perform Hajj, may perform Hajj on their behalf after having performed their own Hajj.

Some scholars have said: One should only perform Hajj on their behalf if they have made a bequest. Other scholars have said that it is permissible to perform Hajj on their behalf even without a bequest.

This is also the position of Imam Darimi rahimahullah, and the writer has also heard this from Samahat al-Shaykh Ibn Baz rahimahullah, that it is permissible to perform Hajj on behalf of one’s parents.

One type of Hajj is Hajj al-Badal (substitute Hajj), which is performed as a proxy on behalf of someone who is incapacitated or deceased. At the time of making the intention (niyyah), along with the talbiyah (labbaik), the name of the person on whose behalf the Hajj is being performed should be mentioned, for example: «لبيك عن زيد نيابتةً». However, it is necessary for Hajj al-Badal that the person performing the Hajj has already performed Hajj for himself, as is clarified in the hadith of Shubrumah.
