Hadith 1762

حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ، حَدَّثَنَا لَيْثُ بْنُ سَعْدٍ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللَّهِ بْنِ الْأَشَجِّ، عَنْ عَبْدِ الْمَلِكِ بْنِ سَعِيدٍ الْأَنْصَارِيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنْ عُمَرَ بْنِ الْخَطَّابِ، قَالَ: هَشِشْتُ فَقَبَّلْتُ وَأَنَا صَائِمٌ، فَجِئْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقُلْتُ: إِنِّي صَنَعْتُ الْيَوْمَ أَمْرًا عَظِيمًا: قَبَّلْتُ وَأَنَا صَائِمٌ . قَالَ: "أَرَأَيْتَ لَوْ مَضْمَضْتَ مِنْ الْمَاءِ ؟"قُلْتُ: إِذًا لَا يَضُرُّ . قَالَ: "فَفِيمَ ؟".
Sayyiduna Umar bin Al-Khattab (may Allah be pleased with him) said: I came in a state of happiness and kissed (my wife) while I was fasting. Then I went to the Messenger of Allah (peace and blessings be upon him) and said: Today I have committed a great sin; I was fasting and I kissed (my wife). The Messenger of Allah (peace and blessings be upon him) said: "What do you think if you rinse your mouth with water while fasting?" I said: There is no harm in that. He said: "Then why should there be any harm in this?"

Brief Explanation
(Commentary on Hadiths 1759 to 1762)

Sayyiduna Umar al-Faruq radi Allahu anhu, such a noble and eminent Companion, committed a seemingly minor act, yet the fear of accountability was so intense that he, in a state of anxiety, presented himself before the Benefactor of Humanity sallallahu alayhi wa sallam. He narrated the incident, upon which the Noble Prophet sallallahu alayhi wa sallam, with utmost compassion and love, explained by giving an example: just as rinsing the mouth (during ablution) does not invalidate the fast, similarly, kissing and embracing do not invalidate it either. In this way, the worry of Sayyiduna Umar radi Allahu anhu was alleviated and he was reassured.

The Shari‘ah is the name of an easy and comprehensive law, which must relate to every aspect of life. The relationship between husband and wife is evident, and for this reason, kissing and embracing one’s wife during the state of fasting has been permitted, provided that the fasting person has complete control over his desires (as is mentioned regarding the Messenger of Allah sallallahu alayhi wa sallam: «كَانَ أَمْلَكُكُمْ لِإِرْبِهِ»—that the Noble Prophet sallallahu alayhi wa sallam had greater control over his desires than you).

For this reason (some scholars have said), kissing and embracing are not permitted for the youth, as their desires tend to overpower them. However, if there is no such fear, then it is permissible (Maulana Raz rahimahullah).
