Hadith 1721

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، حَدَّثَنَا إِسْمَاعِيل بْنُ عُلَيَّةَ، حَدَّثَنَا حَاتِمُ بْنُ أَبِي صَغِيرَةَ، عَنْ سِمَاكِ بْنِ حَرْبٍ، قَالَ: أَصْبَحْتُ فِي يَوْمٍ قَدْ أُشْكِلَ عَلَيَّ مِنْ شَعْبَانَ، أَوْ مِنْ شَهْرِ رَمَضَانَ، فَأَصْبَحْتُ صَائِمًا، فَأَتَيْتُ عِكْرِمَةَ، فَإِذَا هُوَ يَأْكُلُ خُبْزًا وَبَقْلًا، فَقَالَ: هَلُمَّ إِلَى الْغَدَاءِ . فَقُلْتُ: إِنِّي صَائِمٌ . فَقَالَ: أُقْسِمُ بِاللَّهِ لَتُفْطِرَنَّ . فَلَمَّا رَأَيْتُهُ حَلَفَ وَلَا يَسْتَثْنِي، تَقَدَّمْتُ فَعَذَّرْتُ وَإِنَّمَا تَسَحَّرْتُ قُبَيْلَ ذَلِكَ، ثُمَّ قُلْتُ: هَاتِ الْآنَ مَا عِنْدَكَ . فَقَالَ: حَدَّثَنَا ابْنُ عَبَّاسٍ رَضِيَ اللهِ عَنْهُمَا، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: "صُومُوا لِرُؤْيَتِهِ وَأَفْطِرُوا لِرُؤْيَتِهِ، فَإِنْ حَالَ بَيْنَكُمْ وَبَيْنَهُ سَحَابٌ، فَكَمِّلُوا الْعِدَّةَ ثَلَاثِينَ، وَلَا تَسْتَقْبِلُوا الشَّهْرَ اسْتِقْبَالًا".
Simak bin Harb said: I woke up one morning when it was difficult for me to know whether it was Sha'ban or a day of the month of Ramadan, so I fasted. I went to Ikrimah and saw that he was eating bread and vegetables. He said: Come and eat food. I said: I am fasting. Ikrimah said: I swear by Allah, you must break your fast. When I saw that he had sworn an oath and did not say "insha'Allah," I went ahead and ate heartily, even though a little while before I had taken suhoor. After that, I said: Now tell me, what do you have regarding this matter? He said: Ibn Abbas (may Allah be pleased with them both) narrated to us that the Messenger of Allah (peace and blessings be upon him) said: "Fast when you see the crescent and break your fast when you see the crescent. If clouds come between you and the crescent, then complete thirty days (of Sha'ban), and do not fast in anticipation of Ramadan."

Brief Explanation
(Commentary on Hadith 1720)

From this hadith, it is understood that if the crescent of Ramadan is not sighted, it is prohibited to fast, and if someone does fast, his fast should be broken, because this is a clear violation of the command of the Messenger of Allah sallallahu alayhi wa sallam: «صُوْمُوْا لِرُؤْيَتِهِ» and «لَا تَصُوْمُوْا حَتَّىٰ تَرَوا الْهِلَال». For this reason, the esteemed scholars have declared that just as it is forbidden to not fast after sighting the crescent, it is also forbidden to fast without sighting the crescent.

In such a situation, when it is cloudy and the crescent is not visible, then the month of Sha'ban should be completed, and after thirty days, fasting should begin; at that time, the condition of sighting the crescent is not required.

In this hadith, there is also a prohibition against fasting one or two days before the beginning of Ramadan in anticipation of Ramadan.
