Hadith 1715

Bahz bin Hakim narrated from his grandfather, who narrated from his father, that he heard the Messenger of Allah (peace be upon him) say: "For every forty camels grazing in the wilderness, one bint labun (a two-year-old she-camel) is due as zakat, and the camels should not be separated from their place (to avoid zakat). Whoever pays zakat seeking reward will receive a reward, and whoever withholds zakat, we will take the zakat from him, and in addition, half of his wealth as a penalty for withholding it, because this is one of the obligations imposed by Allah the Exalted. Nothing from it is lawful for the family of Muhammad."

Brief Explanation
(Commentary on Hadith 1714)

The earlier opinion of Imam Ahmad and Imam Shafi'i rahimahullah is that when a person does not give zakat, then zakat should be taken from him, and half of his wealth should be taken as a penalty. According to most scholars, this ruling was in the early period of Islam (and) when it was permissible to take a penalty, but later this ruling was abrogated.

Also, from this hadith it is understood that it is not permissible for the family of Muhammad sallallahu alayhi wa sallam to take charity (sadaqah), as has already been mentioned. Furthermore, it is also understood that the minimum threshold (nisab) for camels is five camels; the details of this have already been discussed in previous pages.
