Hadith 138

حَدَّثَنَا حَدَّثَنَا يُوسُفُ بْنُ يَعْقُوبَ الصَّفَّارُ، حَدَّثَنَا أَبُو بَكْرٍ، عَنْ دَاوُدَ، قَالَ: سَأَلْتُ الشَّعْبِيَّ، كَيْفَ كُنْتُمْ تَصْنَعُونَ إِذَا سُئِلْتُمْ ؟، قَالَ: "عَلَى الْخَبِيرِ وَقَعْتَ، كَانَ إِذَا سُئِلَ الرَّجُلُ، قَالَ لِصَاحِبِهِ: أَفْتِهِمْ، فَلَا يَزَالُ حَتَّى يَرْجِعَ إِلَى الْأَوَّلِ".
Dawud bin Abi Hind said: I asked Sha'bi: What would you do when you were asked about an issue? He replied: You have asked someone experienced in this matter. When someone was asked about an issue, he would say to his companion, "You answer," and the companion would say, "You answer," until after repetition, the question would return to the first person.

From this narration, the necessity of caution in issuing fatwas (legal verdicts) is established. Furthermore, it shows that their companions and associates were of the same character as themselves, and in this is a lesson that the company of the righteous leads to righteousness.
