باب مَنْ هَابَ الْفُتْيَا وَكَرِهَ التَّنَطُّعَ وَالتَّبَدُّعَ:Chapter: Those Who Feared Giving Fatwa and Disliked Excessiveness and Innovation
Hadith 136
أَخْبَرَنَا أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ، أَخْبَرَنَا أَحْمَدُ بْنُ بَشِيرٍ، حَدَّثَنَا شُعْبَةُ، عَنْ جَعْفَرِ بْنِ إِيَاسٍ، قَالَ: قُلْتُ لِسَعِيدِ بْنِ جُبَيْرٍ: مَا لَكَ لَا تَقُولُ فِي الطَّلَاقِ شَيْئًا ؟، قَالَ: "مَا مِنْهُ شَيْءٌ إِلَّا قَدْ سَأَلْتُ عَنْهُ، وَلَكِنِّي أَكْرَهُ أَنْ أُحِلَّ حَرَامًا، أَوْ أُحَرِّمَ حَلَالًا".
Ja'far bin Iyas said: I said to Sa'id bin Jubayr, may Allah have mercy on him: What is the matter that you do not speak about the issue of divorce? He said: There is nothing related to divorce about which I have not asked (i.e., have not acquired knowledge), but I do not like to declare the unlawful as lawful and the lawful as unlawful.
