جماع أبواب ذكر أفعال اختلف الناس فى إباحته للمحرم، نصت سنة النبى صلى الله عليه وسلم أو دلت على إباحتهاChapters on Acts Permitted for the Pilgrim by Sunnah
(406) بَابُ الْحَجِّ عَمَّنْ يَجِبُ عَلَيْهِ الْحَجُّ بِالْإِسْلَامِ، أَوْ مِلْكِ الْمَالِ، أَوْ هُمَا وَهُوَ غَيْرُ مُسْتَطِيعٍ لِلْحَجِّ بِبَدَنِهِ مِنَ الْكِبَرِ،
Hajj on behalf of one who is obligated due to Islam or wealth but unable to perform it due to old age.
Hadith Q3036
وَالْفَرْقُ بَيْنَ الْعَاجِزِ عَنِ الْحَجِّ بِبَدَنِهِ لِكِبَرِ السِّنِّ، وَبَيْنَ الْعَاجِزِ عَنِ الْحَجِّ لِمَرَضٍ قَدْ يُرْجَى لَهُ الْبُرْءُ إِذِ الْعَاجِزُ لِكِبَرِ السِّنِّ لَا يَحْدُثُ لَهُ شَبَابٌ وَقُوَّةٌ بَعْدُ، وَالْمَرِيضُ قَدْ يَصِحُّ مِنْ مَرَضِهِ بِإِذْنِ اللَّهِ.
There is a difference between a person who is unable to perform Hajj due to old age and a person who is unable due to illness, because a person who is unable due to old age cannot regain youth and strength, whereas a sick person can recover by the command and mercy of Allah Almighty.
Hadith 3036
حَدَّثَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ ، قَالَ : قَالَ الشَّافِعِيُّ : أَخْبَرَنَا مَالِكٌ . ح وحَدَّثَنَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، أَخْبَرَنَا ابْنُ وَهْبٍ ، أَنَّ مَالِكًا أَخْبَرَهُ ، عَنِ ابْنِ شِهَابٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : كَانَ الْفَضْلُ بْنُ عَبَّاسٍ رَدِيفَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَجَاءَتْهُ امْرَأَةٌ مِنْ خَثْعَمٍ تَسْتَفْتِيهِ ، فَجَعَلَ الْفَضْلُ يَنْظُرُ إِلَيْهَا ، وَتَنْظُرُ إِلَيْهِ فَجَعَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَصْرِفُ وَجْهَ الْفَضْلِ إِلَى الشِّقِّ الآخَرِ ، فَقَالَتْ : يَا رَسُولَ اللَّهِ ، إِنَّ فَرِيضَةَ اللَّهِ عَلَى عِبَادِهِ فِي الْحَجِّ أَدْرَكَتْ أَبِي شَيْخًا كَبِيرًا لا يَسْتَطِيعُ أَنْ يَثْبُتَ عَلَى الرَّاحِلَةِ ، أَفَأَحُجُّ عَنْهُ ؟ قَالَ : " نَعَمْ " ، وَذَلِكَ فِي حَجَّةِ الْوَدَاعِ
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates that Sayyiduna Fadl bin Abbas (may Allah be pleased with them both) was riding behind the Messenger of Allah (peace and blessings be upon him) when a woman from the tribe of Khath’am came to ask the Prophet a question. Sayyiduna Fadl bin Abbas (may Allah be pleased with them both) began to look at her and she also started looking at Sayyiduna Fadl bin Abbas (may Allah be pleased with them both), so the Messenger of Allah (peace and blessings be upon him) turned the face of Sayyiduna Fadl bin Abbas (may Allah be pleased with them both) to the other side with his blessed hand. She said, “O Messenger of Allah, Allah has made Hajj obligatory upon His servants, but my elderly father is not able to sit firmly on a mount. Should I perform Hajj on his behalf?” The Prophet (peace and blessings be upon him) replied, “Yes.” And this incident took place during the Farewell Pilgrimage.
