Hadith 2644
حَدَّثَنَا
مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الْمُخَرِّمِيُّ ، حَدَّثَنَا
إِسْحَاقُ بْنُ عِيسَى ، حَدَّثَنَا
حَمَّادُ بْنُ سَلَمَةَ ، عَنْ
قَيْسٍ ، عَنْ
طَاوُسٍ ، عَنِ
ابْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : يَا
زَيْدَ بْنَ أَرْقَمَ ، " هَلْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُهْدِيَ لَهُ بَيْضَاتُ نَعَامٍ وَهُوَ حَرَامٌ فَرَدَّهُنَّ ؟ قَالَ : نَعَمْ " ، قَالَ أَبُو بَكْرٍ : فِي خَبَرِ جَابِرٍ : " لَحْمُ الصَّيْدِ حَلالٌ لَكُمْ وَأَنْتُمْ حُرُمٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَدْ لَكُمْ " ، دَلالَةٌ عَلَى أَنَّ بَيْضَ الصَّيْدِ مُبَاحٌ لِلْمُحْرِمِ إِذَا لَمْ يُؤْخَذْ مِنْ أَجْلِ الْمُحْرِمِ ، لأَنَّ حُكْمَ بَيْضِ الصَّيْدِ لا يَكُونُ أَكْثَرَ مِنْ حُكْمِ لَحْمِهِ
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he said, "O Sayyiduna Zaid bin Arqam (may Allah be pleased with him), do you know that ostrich eggs were gifted to the Messenger of Allah (peace and blessings of Allah be upon him) while he was in the state of Ihram, and he returned those eggs?" He replied, "Yes, I know this." Imam Abu Bakr (may Allah have mercy on him) says that in the narration of Sayyiduna Jabir (may Allah be pleased with him), it is mentioned that when you are in the state of Ihram, it is permissible for you to eat the meat of game as long as you did not hunt it yourself, nor was it hunted specifically for you. This indicates that it is permissible for a Muhrim (one in Ihram) to eat the egg of a game animal, provided it was not obtained specifically for the Muhrim. Because the ruling regarding the egg of a game animal is not stricter than that of its meat.
