86 Subchapter: Entering ihram after an obligatory prayer if present

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ شُعْبَةَ ، عَنْ قَتَادَةَ ، عَنْ أَبِي حَسَّانَ الأَعْرَجِ ، عَنِ ابْنِ عَبَّاسٍ : " أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ صَلَّى الظُّهْرَ ، وَأَمَرَ بِبُدْنِهِ أَنْ تُشْعَرَ مِنْ شِقِّهَا الأَيْمَنِ ، وَقَلَّدَهَا نَعْلَيْنِ ، وَسَلَتْ عَنْهَا الدَّمَ ، فَلَمَّا اسْتَوَتْ بِهِ الْبَيْدَاءَ أَهَلَّ " ، حَدَّثَنَا بُنْدَارٌ ، أَيْضًا حَدَّثَنَا مُحَمَّدُ يَعْنِي ابْنَ جَعْفَرٍ ، حَدَّثَنَا شُعْبَةُ ، بِهَذَا الإِسْنَادِ بِمِثْلِهِ ، وَقَالَ : صَلَّى الظُّهْرَ بِذِي الْحُلَيْفَةِ ، وَأَشْعَرَ بَدَنَتَهُ ، وَلَمْ يَقُلْ : وَسَلَتَ عَنْهَا الدَّمَ ، قَالَ أَبُو بَكْرٍ : هَذِهِ اللَّفْظَةُ الَّتِي فِي خَبَرِ مُحَمَّدِ بْنِ جَعْفَرٍ ، وَأَشْعَرَ بَدَنَتَهُ مِنَ الْجِنْسِ الَّذِي بَيَّنْتُهُ فِي غَيْرِ مَوْضِعٍ مِنْ كُتُبِنَا أَنَّ الْعَرَبَ تُضِيفُ الْفِعْلَ إِلَى الآمْرِ كَإِضَافَتِهَا إِلَى الْفِاعْلِ ، فَقَوْلُهُ : وَأَشْعَرَ بَدَنَتَهُ يُرِيدُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ بِإِشْعَارِهَا ، لأَنَّ فِي خَبَرِ يَحْيَى الْقَطَّانِ ، وَأَمَرَ بِبَدَنِهِ أَنْ تُشْعَرَ دَلالَةٌ عَلَى أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ بِإِشْعَارِهَا لا أَنَّهُ تَوَلَّى ذَلِكَ بِنَفْسِهِ ، وَقَدْ يُحْتَمَلُ أَنْ يَكُونَ أَشْعَرَ بَعْضَ بُدْنِهِ بِيَدِهِ وَأَمَرَ غَيْرَهُ بِإِشْعَارِ بَقِيَّتِهَا فَمَنْ قَالَ فِي الْخَبَرِ : أَمَرَ بِبُدْنِهِ أَنْ تُشْعَرَ أَرَادَ بَعْضَهَا ، وَمَا قَالَ : أَشْعَرَ بَدَنَتَهُ أَرَادَ بَعْضَهَا لا كُلَّهَا فَالأَخْبَارُ مُتَصَادِقَةٌ لا مُتَكَاذِبَةٌ عَلَى مَا يُتَوَهَّمُ أَهْلُ الْجَهْلِ
Sayyiduna Ibn Abbas (may Allah be pleased with both of them) narrates that the Noble Prophet (peace and blessings be upon him) offered the Zuhr prayer and ordered that his sacrificial animal be marked on the right side. He hung two sandals around its neck and cleaned its blood. Then, when his she-camel straightened with him at the place of Baida, the Prophet (peace and blessings be upon him) made the intention and recited the Talbiyah. In the narration of Janab Bandad, it is mentioned that the Messenger of Allah (peace and blessings be upon him) offered the Zuhr prayer at Dhul-Hulaifah and performed Ish'ar (marking) on his sacrificial animal, and these words are not mentioned that he cleaned its blood. Imam Abu Bakr (may Allah have mercy on him) says that the words in the narration of Janab Muhammad bin Ja'far, "and the Prophet (peace and blessings be upon him) performed Ish'ar on his sacrificial animal," this issue belongs to the same category which we have mentioned several times in our books: that the Arabs attribute an action to the one who commands it just as they attribute it to the one who actually performs it. Therefore, the words of the hadith, "the Prophet (peace and blessings be upon him) performed Ish'ar on his sacrificial animal," mean that the Noble Prophet (peace and blessings be upon him) ordered Ish'ar to be done, because in the narration of Janab Yahya bin Qatan, it is mentioned that the Prophet (peace and blessings be upon him) ordered his sacrificial animal to be marked. This is evidence that he ordered Ish'ar to be done, not that he did it himself. And it is also possible that the Prophet (peace and blessings be upon him) himself performed Ish'ar on some camels with his blessed hand and ordered the rest to be marked. Therefore, in the narration where the command of Ish'ar is mentioned, it means that he ordered some camels to be marked. And in the narration where it is said that the Prophet (peace and blessings be upon him) himself performed Ish'ar on his sacrificial animals, it also refers to some camels, not all of them. In this way, all these narrations confirm and verify each other; they do not contradict each other as some ignorant people think.
