37 Subchapter: Evidence that the Prophet only permitted loading riding animals

حَدَّثَنَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، أَخْبَرَنَا ابْنُ وَهْبٍ ، أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ ، عَنْ أَبِيهِ ، عَنِ الأَعْرَجِ ، عَنْ أَبِي هُرَيْرَةَ رَضِي اللَّهُ عَنْهُ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " إِنَّ عَلَى ذُرْوَةِ كُلِّ بَعِيرٍ شَيْطَانًا فَامْتَهِنُوهُنَّ بِالرُّكُوبِ ، وَإِنَّمَا يَحْمِلُ اللَّهُ " ، قَالَ أَبُو بَكْرٍ : فِي خَبَرِ مُعَاذِ بْنِ أَنَسٍ الْجُهَنِيِّ ، عَنْ أَبِيهِ دَلالَةٌ عَلَى أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا أَبَاحَ الْحَمْلَ عَلَيْهَا فِي السَّيْرِ طَلَبًا لِقَضَاءِ الْحَاجَةِ إِذَا كَانَتِ الدَّابَّةُ الْمَرْكُوبَةُ مُحْتَمِلَةٌ لِلْحَمْلِ عَلَيْهَا ، لأَنَّهُ قَالَ : " ارْكَبُوهَا سَالِمَةً ، وَابْتَدِعُوهَا سَالِمَةً " ، وَكَذَلِكَ فِي خَبَرِ سَهْلٍ ارْكَبُوهَا صَالِحَةً وَكُلُوهَا صَالِحَةً ، فَإِذَا كَانَ الأَغْلَبُ مِنَ الدَّوَابِّ الْمَرْكُوبَةِ أَنَّهَا إِذَا حُمِلَ عَلَيْهَا فِي الْمَسِيرِ عَطِبَتْ لَمْ يَكُنْ لِرَاكِبِهَا الْحَمْلُ عَلَيْهَا . . . . . النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدِ اشْتَرَطَ أَنْ تُرْكَبَ سَالِمَةً ، وَيُشْبِهُ أَنْ يَكُونَ مَعْنَى قَوْلِهِ ، ارْكَبُوهَا سَالِمَةً أَيْ رُكُوبًا تَسْلَمُ مِنْهُ ، وَلا تَعْطِبُ ، وَاللَّهُ أَعْلَمُ
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) say: “Indeed, there is a devil on every camel’s hump. So make good use of them, for surely it is Allah, the Exalted, Who makes you ride.” Imam Abu Bakr (may Allah have mercy on him) says that in the narration of Sayyiduna Mu’adh bin Anas al-Juhani (may Allah be pleased with him) from his father, there is evidence that the Noble Prophet (peace and blessings be upon him) permitted loading luggage on riding animals during travel so that the rider may fulfill his purpose and meet his needs. This permission is given when the riding animal is capable of bearing the load. Because the Prophet (peace and blessings be upon him) said: “Ride the animal when it is healthy, and leave it in a sound condition (not when it is near death).” Similarly, in the narration of Sayyiduna Sahl (may Allah be pleased with him), it is stated: “Ride these animals when they are fit for riding, and eat their meat when they are healthy and fit for eating.” Therefore, when it is likely that loading luggage on the riding animal during travel will exhaust it, then the rider should not load luggage on it... because the Noble Prophet (peace and blessings be upon him) has stipulated the condition that it should be ridden while it is sound and healthy. And it is also possible that the meaning of his statement: “Ride them while they are healthy,” is that you should ride them in such a state that the camel remains sound and does not become exhausted and unable to continue the journey. And Allah knows best.
