جماع أبواب صدقة التطوعChapters on Voluntary Charity
(155) بَابُ ذِكْرِ الدَّلِيلِ عَلَى أَنَّ احْتِمَالَ الشَّهَادَةِ بِصَدَقَةِ الْعَقَارِ جَائِزٌ لِلشُّهُودِ إِذَا عَلِمُوا الْعَقَارَ الْمُتَصَدَّقَ بِهِ مِنْ غَيْرِ تَحْدِيدٍ،
155 Subchapter: Witnesses may testify to charity of land if they know it, even without exact details
Hadith Q2460
إِذِ الْعَقَارُ مَشْهُورٌ بِالْمُتَصَدِّقِ مَنْسُوبٌ إِلَيْهِ مُسْتَغْنٍ بِشُهْرَتِهِ وَنِسْبَتِهِ إِلَى الْمُتَصَدِّقِ بِهِ عَنْ ذِكْرِ تَحْدِيدِهِ، وَالدَّلِيلُ عَلَى إِبَاحَةِ الْحَاكِمِ احْتِمَالَ الشَّهَادَةِ إِذَا شَهِدَ عَلَيْهَا.
This will be when the land is attributed to the person giving charity and its ownership is well-known as his; due to this attribution and fame, there will be no need for specification. And the evidence for this is that when the ruler is made a witness regarding such land, he can become a witness.
Hadith 2460
حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي صَفْوَانَ الثَّقَفِيُّ ، حَدَّثَنَا بَهْزٌ ، حَدَّثَنَا حَمَّادٌ ، عَنْ ثَابِتٍ ، عَنْ أَنَسٍ ، قَالَ : لَمَّا نَزَلَتْ هَذِهِ الآيَةُ : لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ سورة آل عمران آية 92 ، قَالَ أَبُو طَلْحَةَ : أَرَى رَبَّنَا يَسْأَلُنَا أَمْوَالَنَا ، فَأُشْهِدُكَ يَا رَسُولَ اللَّهِ ، إِنِّي قَدْ جَعَلْتُ أَرْضِي بَيْرَحَى لِلَّهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " اجْعَلْهَا فِي قَرَابَتِكَ " ، قَالَ : فَجَعَلَهَا فِي حَسَّانِ بْنِ ثَابِتٍ ، وَأُبَيِّ بْنِ كَعْبٍ
Sayyiduna Anas (may Allah be pleased with him) narrates that when this verse was revealed « لَن تَنَالُوا الْبِرَّ حَتَّىٰ تُنفِقُوا مِمَّا تُحِبُّونَ » [ سورة آل عمران : 92 ] "You will never attain righteousness until you spend from that which you love," Sayyiduna Abu Talhah (may Allah be pleased with him) said, "I think our Lord is asking us for our wealth. Therefore, O Messenger of Allah, I make you a witness that I have given my land of Bairuha for Allah." So the Messenger of Allah (peace and blessings be upon him) said, "Distribute that land among your relatives." Thus, Sayyiduna Abu Talhah (may Allah be pleased with him) distributed that land between Sayyiduna Hassan bin Thabit and Ubayy bin Ka'b (may Allah be pleased with them both).
