جماع أبواب قسم الصدقات وذكر أهل سهمانهاChapters on Distribution of Zakat and its Recipients
(96) بَابُ أَمْرِ الْإِمَامِ الْمُصَدِّقَ بِقَسْمِ الصَّدَقَةِ حَيْثُ يَقْبِضُ، إِنْ صَحَّ الْخَبَرُ، فَإِنَّ فِي الْقَلْبِ مِنْ أَشْعَثَ بْنِ سَوَّارٍ، وَإِنْ لَمْ يَثْبُتْ هَذَا الْخَبَرُ، فَخَبَرُ ابْنِ عَبَّاسٍ فِي أَمْرِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مُعَاذًا بِأَخْذِ الصَّدَقَةِ مِنْ أَغْنِيَاءِ أَهْلِ الْيَمَنِ وَقَسْمِهَا فِي فُقَرَائِهِمْ- كَافٍ مِنْ هَذَا الْخَبَرِ
96| Chapter on the imam instructing the zakat collector to distribute zakat where it is collected, if the report is authentic; if not, the report of Ibn Abbas about the Prophet’s instruction to Mu‘adh to take zakat from the rich of Yemen and give it to their poor is sufficient
Hadith 2379
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ ، حَدَّثَنَا عُمَرُ بْنُ عَلِيِّ بْنِ عَطَاءِ بْنِ مَقْدَمٍ الْمُقَدَّمِيُّ ، حَدَّثَنَا أَشْعَثُ بْنُ سَوَّارٍ ، عَنْ عَوْنِ بْنِ أَبِي جُحَيْفَةَ ، عَنْ أَبِيهِ ، قَالَ : " بَعَثَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَجُلا سَاعِيًا عَلَى الصَّدَقَةِ ، وَأَمَرَهُ أَنْ يَأْخُذَ مِنَ الأَغْنِيَاءِ ، فَيَقْسِمُهُ عَلَى الْفُقَرَاءِ ، فَأَمَرَ لِي بِقَلُوصٍ "
Sayyiduna Abu Juhaifah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) sent a man to collect zakat and instructed him to take zakat from the wealthy and distribute it among the poor (of that area). So he ordered that a young she-camel be given to me as well (because I was also among the deserving ones).
