(95) بَابُ الرُّخْصَةِ فِي إِعْطَاءِ الْإِمَامِ الْمُظَاهِرَ مِنَ الصَّدَقَةِ مَا يُكَفِّرُ بِهِ عَنْ ظِهَارَهِ، إِذَا لَمْ يَكُنْ وَاجِدًا لِلْكَفَّارَةِ
95| Chapter on the concession to give the one who has made a vow of zihar from zakat to help him expiate if he cannot afford it
Hadith 2378
حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ ، وَالْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ ، وَمُحَمَّدُ بْنُ يَحْيَى ، وَأَحْمَدُ بْنُ سَعِيدٍ الدَّارِمِيُّ ، وَأَحْمَدُ بْنُ الْخَلِيلِ ، قَالُوا : حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ ، عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَطَاءٍ ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ ، عَنْ سَلَمَةَ بْنِ صَخْرٍ الأَنْصَارِيِّ ، قَالَ : كُنْتُ امْرَأً قَدْ أُوتِيتُ مِنْ جِمَاعِ النِّسَاءِ مَا لَمْ يُؤْتَ غَيْرِي ، فَلَمَّا دَخَلَ رَمَضَانُ تَظَاهَرْتُ مِنَ امْرَأَتِي مَخَافَةَ أَنْ أُصِيبَ مِنْهَا شَيْئًا فِي بَعْضِ اللَّيْلِ ، فَأَتَتَابَعُ فِي ذَلِكَ ، فَلا أَسْتَطِيعُ أَنْ أَنْزِعَ حَتَّى يُدْرِكَنِي الصُّبْحُ ، فَبَيْنَا هِيَ ذَاتُ لَيْلَةٍ تَخْدُمُنِي إِذْ تَكَشَّفَ لِي مِنْهَا شَيْءٌ ، فَوَثَبْتُ عَلَيْهَا ، فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى قَوْمِي ، فَأَخْبَرْتُهُمْ خَبَرِي ، فَقُلْتُ : انْطَلِقُوا مَعِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلأُخْبِرُهُ ، قَالُوا : لا ، وَاللَّهِ لا نَذْهَبُ مَعَكَ نَخَافُ أَنْ يَنْزِلَ فِينَا قُرْآنٌ أَوْ يَقُولُ فِينَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، مَقَالَةً يَبْقَى عَلَيْنَا عَارُهَا ، فَاذْهَبْ أَنْتَ وَاصْنَعْ مَا بَدَا لَكَ ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَخْبَرْتُهُ خَبَرِي ، قَالَ : " أَنْتَ بِذَاكَ ؟ " قَالَ : أَنَا بِذَاكَ ، وَهَأَنَا ذَا فَأَمْضِ فِيَّ حُكْمَ اللَّهِ فَإِنِّي صَابِرٌ مُحْتَسِبٌ ، قَالَ : " اعْتِقْ رَقَبَةً " ، فَضَرَبْتُ صَفْحَةَ رَقَبَتِي بِيَدِي ، فَقُلْتُ : وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ غَيْرَهَا ، قَالَ : " صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ " ، قَالَ : قُلْتُ : يَا رَسُولَ اللَّهِ ، وَهَلْ أَصَابَنِي مَا أَصَابَنِي إِلا فِي الصِّيَامِ ؟ قَالَ : " أَطْعِمْ سِتِّينَ مِسْكِينًا " ، قُلْتُ : يَا رَسُولَ اللَّهِ ، وَالَّذِي بَعَثَكَ بِالْحَقِّ ، لَقَدْ بِتْنَا لَيْلَتَنَا هَذِهِ حَشَاءً مَا نَجِدُ عَشَاءً ، قَالَ : " فَانْطَلِقْ إِلَى صَاحِبِ الصَّدَقَةِ ، صَدَقَةِ بَنِي زُرَيْقٍ ، فَمُرْهُ فَلْيَدْفَعْهَا إِلَيْكَ فَأَطْعِمْ مِنْهَا وَسْقًا سِتِّينَ مِسْكِينًا ، وَاسْتَعِنْ بِسَائِرِهَا عَلَى عِيَالِكَ " , فَأَتَيْتُ قَوْمِي ، فَقُلْتُ : وَجَدْتُ عِنْدَكُمُ الضِّيقَ ، قَالَ أَبُو بَكْرٍ : لَمْ أَفْهَمْ عَنِ الدَّوْرَقِيِّ مَا بَعْدَهَا ، وَقَالَ الآخَرُونَ : وَجَدْتُ عِنْدَكُمُ الضِّيقَ ، وَسُوءَ الرَّأْيِ ، وَوَجَدْتُ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ السَّعَةَ وَالْبَرَكَةَ ، قَدْ أَمَرَ لِي بِصَدَقَتِكُمْ فَادْفَعُوهَا إِلَيَّ ، قَالَ : فَدَفَعُوهَا إِلَيَّ ، وَقَالَ بَعْضُهُمْ : حَسَاءً
Salamah bin Sakhr Ansari (may Allah be pleased with him) narrates that the strength I had for intercourse with women was not possessed by anyone else. When the month of Ramadan came, I made zihar (declared my wife unlawful to me) from my wife, fearing that I might have intercourse with her on one of the nights of Ramadan, and then remain engaged in that act until morning and not be able to finish. Then, one night while she was serving me, a part of her body became exposed before me (so I could not control myself, therefore) I jumped upon her and had intercourse with her. When morning came, I went to my people and informed them of what I had done. I requested them to come with me to the Messenger of Allah (peace and blessings be upon him) so that I could inform him of my situation. They replied, "No, by Allah, we will not go with you. We fear that the Qur'an might be revealed about us or the Messenger of Allah (peace and blessings be upon him) might say something about us that would bring us everlasting shame and disgrace. So you go yourself and do whatever you wish."
So I presented myself before the Messenger of Allah (peace and blessings be upon him) and informed him of what I had done. He (peace and blessings be upon him) said, "Did you really do that?" I replied, "Yes, I did, and now I am present before you, so impose Allah's command upon me. I will bear the punishment with patience, seeking reward." He (peace and blessings be upon him) said, "Free a slave." I struck my neck with my hand and said, "By the One Who has sent you with the truth, I do not own anyone except this neck." He (peace and blessings be upon him) said, "Then fast for two consecutive months." I said, "O Messenger of Allah (peace and blessings be upon him), I committed this mistake in Ramadan itself. (How can I fast more days?)" He (peace and blessings be upon him) said, "Feed sixty needy people." I said, "O Messenger of Allah (peace and blessings be upon him), by the One Who has sent you with the truth, we spent last night hungry; we did not even have food for the night." He (peace and blessings be upon him) said, "Go to the collector of zakat of Banu Zurayq and tell him to give you the zakat of Banu Zurayq. Feed sixty needy people from it, and spend the rest on your family."
Then I returned to my people and said, "I have found narrow-mindedness and stinginess among you." Imam Abu Bakr (may Allah have mercy on him) says that after this, I could not understand the narration of Duraqi. Other narrators have stated these words: "I found narrow-mindedness and bad opinion among you, whereas I found generosity and blessing with the Messenger of Allah (peace and blessings be upon him). He has ordered me to collect your zakat, so hand it over to me." He says, so they handed over their zakat to me. Some narrators have narrated the word "hisa" (broth) instead of "isha" (night meal).
