(88) بَابُ إِذْنِ الْإِمَامِ لِلْعَامِلِ بِالتَّزْوِيجِ، وَاتِّخَاذِ الْخَادِمِ وَالْمَسْكَنِ مِنَ الصَّدَقَةِ
88| Chapter on the imam permitting the zakat worker to marry, have a servant, and a house from zakat
Hadith 2370
حَدَّثَنَا يَحْيَى بْنُ مَخْلَدِ بْنِ الْمُفْتِي ، حَدَّثَنَا مُعَافَى هُوَ ابْنُ عِمْرَانَ الْمَوْصِلِيُّ ، عَنِ الأَوْزَاعِيِّ ، حَدَّثَنَا حَارِثُ بْنُ يَزِيدَ ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ جُبَيْرٍ ، عَنِ الْمُسْتَوْرِدِ بْنِ شَدَّادٍ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " مَنْ كَانَ لَنَا عَامِلا ، فَلْيَكْتَسِبْ زَوْجَةً ، فَإِنْ لَمْ يَكُنْ لَهُ خَادِمٌ ، فَلْيَكْتَسِبْ خَادِمًا ، وَمَنْ لَمْ يَكُنْ لَهُ مَسْكَنٌ ، فَلْيَكْتَسِبْ مَسْكَنًا " ، قَالَ أَبُو بَكْرٍ : يَعْنِي الْمُعَافَى أُخْبِرْتُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , قَالَ : " مَنِ اتَّخَذَ غَيْرَ ذَلِكَ ، فَهُوَ غَالٌّ أَوْ سَارِقٌ "
Sayyiduna Mustawrid bin Shaddad (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever is appointed as our official, then he may marry (from this zakat wealth), and if he does not have a servant, he may take a servant, and whoever does not have a house, he may take a house." Janab Mu'afi says that I have been informed that the Noble Prophet (peace and blessings be upon him) said: "Whoever takes anything besides these things is a betrayer or a thief."
