(54) بَابُ ذِكْرِ أَخْذِ الصَّدَقَةِ مِنَ الْمَعَادِنِ إِنَّ صَحَّ الْخَبَرُ، فَإِنَّ فِي الْقَلْبِ مِنَ اتِّصَالِ هَذَا الْإِسْنَادِ
54| Chapter on taking zakat from minerals if the report is authentic, though there is doubt about the chain
Hadith 2323
حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى ، حَدَّثَنَا نُعَيْمُ بْنُ حَمَّادٍ ، حَدَّثَنَا عَبْدُ الْعَزِيزِ وَهُوَ ابْنُ مُحَمَّدٍ الدَّرَاوَرْدِيُّ ، عَنْ رَبِيعَةَ وَهُوَ ابْنُ أَبِي عَبْدِ الرَّحْمَنِ ، عَنِ الْحَارِثِ بْنِ بِلالٍ ، عَنْ أَبِيهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَخَذَ مِنْ مَعَادِنِ الْقَبِيلَةِ الصَّدَقَةَ ، وَأَنَّهُ أَقْطَعَ بِلالَ بْنَ الْحَارِثِ الْعَقِيقَ أَجْمَعَ ، فَلَمَّا كَانَ عُمَرُ ، قَالَ لِبِلالٍ : " إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يَقْطَعْكَ لِتَحْجِزَهُ عَنِ النَّاسِ ، لَمْ يَقْطَعْكَ إِلا لِتَعْمَلَ " ، قَالَ : فَقَطَعَ عُمَرُ بْنُ الْخَطَّابِ لِلنَّاسِ الْعَقِيقَ
It is narrated from Hazrat Bilal bin Harith that the Messenger of Allah (peace be upon him) collected zakat from the minerals located in the Maqam tribe, and he allotted the entire valley of Aqiq to Bilal bin Harith. Then, when the era of Sayyiduna Umar (may Allah be pleased with him) came, he said to Bilal: "Indeed, the Messenger of Allah (peace be upon him) did not allot this land to you so that you would prevent people from it, but rather he gave you this land only so that you would work in it (extract minerals from it)." Then Sayyiduna Umar (may Allah be pleased with him) allotted the area of the valley of Aqiq for all people (so that everyone could benefit from it).
