(27) بَابُ الزَّجْرِ عَنِ الْجَمْعِ بَيْنَ الْمُتَفَرِّقِ وَالتَّفْرِيقِ بَيْنَ الْمُجْتَمِعِ فِي السَّوَائِمِ خِيفَةَ الصَّدَقَةِ وَتَرَاجُعِ الْخَلِيطَيْنِ بَيْنَهُمَا بِالسَّوِيَّةِ فِيمَا أَخَذَ الْمُصَدِّقُ مَاشِيَتَهُمَا جَمِيعًا
27| Chapter on the prohibition of combining separated livestock or separating gathered livestock to avoid zakat, and equal division between partners
Hadith 2279
حَدَّثَنَا بُنْدَارٌ ، وَأَبُو مُوسَى , وَيُوسُفُ بْنُ مُوسَى ، وَمُحَمَّدُ بْنُ يَحْيَى ، قَالُوا : حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنِي أَبِي ، عَنْ ثُمَامَةَ ، قَالَ : حَدَّثَنِي أَنَسُ بْنُ مَالِكٍ ، أَنَّ أَبَا بَكْرٍ الصِّدِّيقِ ، لَمَّا اسْتُخْلِفَ كَتَبَ لَهُ : " بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللَّهُ بِهَا رَسُولَهُ " ، فَذَكَرُوا الْحَدِيثَ ، وَقَالُوا : " لا يَجْمَعُ بَيْنَ مُتَفَرِّقٍ ، وَلا يُفَرِّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ ، وَمَا كَانَ مِنْ خَلِيطَيْنِ ، فَهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ "
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates that when Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) became the Caliph, he had this document written for me: "In the name of Allah, the Most Gracious, the Most Merciful." These are the rulings of the obligation of Zakat which the Messenger of Allah (peace and blessings of Allah be upon him) made obligatory upon the Muslims, and Allah Almighty commanded His Messenger regarding them. Then the narrators narrated the complete hadith, and these words were also narrated: Animals should not be gathered together out of fear of Zakat, nor should gathered animals be separated, and both partners will be equally involved in the collection of Zakat.
