Hadith 1991
حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاءِ بْنِ كُرَيْبٍ ، نا أَبُو أُسَامَةَ ، حَدَّثَنَا هِشَامٌ ، عَنْ فَاطِمَةَ ، عَنْ أَسْمَاءَ . ح وَحَدَّثَنَا أَبُو عَمَّارٍ الْحُسَيْنُ بْنُ حُرَيْثٍ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ هِشَامِ بْنِ عُرْوَةَ ، عَنْ فَاطِمَةَ بِنْتِ الْمُنْذِرِ ، عَنْ أَسْمَاءَ ، قَالَتْ : أَفْطَرْنَا فِي رَمَضَانَ فِي يَوْمِ غَيْمٍ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، ثُمَّ طَلَعَتِ الشَّمْسُ ، قَالَ : قُلْتُ لِهِشَامٍ . وَقَالَ أَبُو عَمَّارٍ : فَقِيلَ لِهِشَامٍ : أُمِرُوا بِالْقَضَاءِ ؟ قَالَ : بُدٌّ مِنْ ذَلِكَ . قَالَ أَبُو بَكْرٍ : لَيْسَ فِي هَذَا الْخَبَرِ أَنَّهُمْ أُمِرُوا بِالْقَضَاءِ ، وَهَذَا مِنْ قَوْلِ هِشَامٍ : بُدٌّ مِنْ ذَلِكَ . لا فِي خَبَرٍ ، وَلا يَبِينُ عِنْدِي أَنَّ عَلَيْهِمُ الْقَضَاءَ ، فَإِذَا أَفْطَرُوا وَالشَّمْسُ عِنْدَهُمْ قَدْ غَرَبَتْ ، ثُمَّ بَانَ أَنَّهَا لَمْ تَكُنْ غَرَبَتْ كَقَوْلِ عُمَرَ بْنِ الْخَطَّابِ : " وَاللَّهِ مَا نَقْضِي مَا يُجَانِفُنَا مِنَ الإِثْمِ "
Lady Asma (may Allah be pleased with her) narrates that during the blessed era of the Messenger of Allah (peace and blessings be upon him), on a cloudy day in Ramadan, we broke our fast, and then the sun appeared. In the narration of Muhammad bin Alaa, it is mentioned: I said to Hisham. And in the narration of Abu Ammar, it is mentioned: Hisham was asked, were the Companions ordered to make up (qada) the fast? He replied: There is no alternative to this. Imam Abu Bakr (may Allah have mercy on him) says that in this narration, it is not mentioned that the Companions were ordered to make up the fast. Rather, it is the statement of Hisham (may Allah have mercy on him) that there is no alternative to this. These are not the words of the narration. In my view, qada is not obligatory upon them at that time when they broke the fast thinking the sun had set, and later it became known that the sun had not yet set. As is the statement of Sayyiduna Umar bin Khattab (may Allah be pleased with him): By Allah, as long as we avoid committing sin, we will not make up (qada). (That is, since we did not do it deliberately, we will not make up the fast.)
