وَلَمْ يَسْتَوْعِبْ أَخْبَارَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْقُنُوتِ، فَاحْتَجَّ بِهَا وَزَعَمَ أَنَّ الْقُنُوتَ فِي الصَّلَاةِ مَنْسُوخٌ مَنْهِيٌّ عَنْهُ‏.‏
And nor has he encompassed all the narrations from the Noble Prophet (peace be upon him) regarding Qunoot; rather, this person has deduced from these narrations and assumes that performing Qunoot in prayer is abrogated and prohibited.

نا مُحَمَّدُ بْنُ يَحْيَى ، نا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ سَالِمٍ ، عَنِ ابْنِ عُمَرَ ، أَنَّهُ سَمِعَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ فِي صَلاةِ الْفَجْرِ حِينَ رَفَعَ رَأْسَهُ مِنَ الرُّكُوعِ : " رَبَّنَا وَلَكَ الْحَمْدُ " فِي الرَّكْعَةِ الأَخِيرَةِ ، ثُمَّ قَالَ : " اللَّهُمَّ الْعَنْ فُلانًا وَفُلانًا " ، دَعَا عَلَى نَاسٍ مِنَ الْمُنَافِقِينَ ، فَأَنْزَلَ اللَّهُ تَبَارَكَ وَتَعَالَى لَيْسَ لَكَ مِنَ الأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ سورة آل عمران آية 128
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that he heard the Noble Prophet (peace and blessings be upon him) in the Fajr prayer, in the last rak‘ah, when he raised his blessed head from ruku‘, he recited « رَبَّنَا وَلَكَ الحَمْدُ », then made this supplication: “O Allah, send curse upon such and such person.” The Prophet (peace and blessings be upon him) invoked against some hypocrites, so Allah the Exalted revealed this verse: « لَيْسَ لَكَ مِنَ الْأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] “O Prophet, you have no authority in this matter; Allah may accept their repentance if He wills, or He may punish them, for indeed they are wrongdoers.”

نا يَحْيَى بْنُ حَبِيبٍ الْحَارِثِيُّ ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ ، عَنْ مُحَمَّدِ بْنِ عَجْلانَ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَدْعُو عَلَى أَرْبَعَةِ نَفَرٍ ، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ لَيْسَ لَكَ مِنَ الأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ سورة آل عمران آية 128 ، قَالَ : فَهَدَاهُمُ اللَّهُ لِلإِسْلامِ . قَالَ أَبُو بَكْرٍ : هَذَا حَدِيثٌ غَرِيبٌ أَيْضًا نا أَحْمَدُ بْنُ الْمِقْدَامِ الْعِجْلِيُّ ، حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ ، حَدَّثَنَا مُحَمَّدُ بْنُ عَجْلانَ ، عَنْ أَبِيهِ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدْعُو عَلَى أَحْيَاءَ مِنَ الْعَرَبِ ، فَأَنْزَلَ اللَّهُ تَبَارَكَ وَتَعَالَى : لَيْسَ لَكَ مِنَ الأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ سورة آل عمران آية 128 قَالَ : ثُمَّ هَدَاهُمْ إِلَى الإِسْلامِ " . قَالَ أَبُو بَكْرٍ : فَفِي هَذِهِ الأَخْبَارِ دَلالَةٌ عَلَى أَنَّ اللَّعْنَ مَنْسُوخٌ بِهَذِهِ الآيَةِ ، لا أَنَّ الدُّعَاءَ الَّذِي كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدْعُو لِمَنْ كَانَ فِي أَيْدِي أَهْلِ مَكَّةَ ، مِنَ الْمُسْلِمِينَ أَنَّ يُنَجِّيَهُمُ اللَّهُ مِنْ أَيْدِيَهُمْ ، إِذْ غَيْرُ جَائِزٍ أَنْ تَكُونَ الآيَةُ نَزَلَتْ : أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ سورة آل عمران آية 128 فِي قَوْمٍ مُؤْمِنِينَ ، فِي يَدَيْ قَوْمٍ كُفَّارٍ يُعَذَّبُونَ ، وَإِنَّمَا أَنْزَلَ اللَّهُ عَزَّ وَجَلَّ هَذِهِ الآيَةَ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ سورة آل عمران آية 128 فِيمَنْ كَانُوا يَدْعُو النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَيْهِمْ بِاللَّعْنِ مِنَ الْمُنَافِقِينَ وَالْكُفَّارِ ، فَأَعْلَمَهُ اللَّهُ عَزَّ وَجَلَّ أَنْ لَيْسَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنَ الأَمْرِ شَيْءٌ فِي هَؤُلاءِ الَّذِينَ كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَلْعَنُهُمْ فِي قُنُوتِهِ ، وَأَخْبَرَ أَنَّهُ إِنْ تَابَ عَلَيْهِمْ فَهَدَاهُمْ لِلإِيمَانِ ، أَوْ عَذَّبَهُمْ عَلَى كُفْرِهِمْ وَنِفَاقِهِمْ فَهُمْ ظَالِمُونَ وَقْتَ كُفْرِهِمْ وَنِفَاقِهِمْ ، لا مَنْ كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدْعُو لَهُمْ مِنَ الْمُؤْمِنِينَ أَنْ يُنَجِّيَهُمْ مِنْ أَيْدِي أَعْدَائِهِمْ مِنَ الْكُفَّارِ ، فَالْوَلِيدُ بْنُ الْوَلِيدِ ، وَسَلَمَةُ بْنُ هِشَامٍ ، وَعَيَّاشُ بْنُ أَبِي رَبِيعَةَ ، وَالْمُسْتَضْعَفُونَ مِنْ أَهْلِ مَكَّةَ لَمْ يَكُونُوا ظَالِمِينَ فِي وَقْتِ دُعَاءِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنْ يُنَجِّيَهُمْ مِنْ أَيْدِي أَعْدَائِهِمُ الْكُفَّارِ ، وَلَمْ يَتْرُكِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الدُّعَاءَ لَهُمْ بِالنَّجَاةِ مِنْ أَيْدِي كُفَّارِ أَهْلِ مَكَّةَ ، إِلا بَعْدَمَا نَجَوْا مِنْ أَيْدِيهِمْ ، لا لِنُزُولِ هَذِهِ الآيَةِ الَّتِي نَزَلَتْ فِي الْكُفَّارِ وَالْمُنَافِقِينَ الَّذِينَ كَانُوا ظَالِمِينَ لا مَظْلُومِينَ ، أَلا تَسْمَعُ خَبَرَ يَحْيَى بْنِ أَبِي كَثِيرٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ : فَأَصْبَحَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ذَاتَ يَوْمٍ فَلَمْ يَدَعُ لَهُمْ ، فَذَكَرْتُ ذَلِكَ لَهُ ، فَقَالَ : " أَوَمَا تُرَاهُمْ قَدْ قَدِمُوا ؟ فَأَعْلَمَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ إِنَّمَا تَرَكَ الْقُنُوتَ وَالدُّعَاءَ بِأَنْ نَجَّاهُمُ اللَّهُ ، إِذِ اللَّهُ قَدِ اسْتَجَابَ لَهُمْ فَنَجَّاهُمْ ، لا لِنُزُولِ الآيَةِ الَّتِي نَزَلَتْ فِي غَيْرِهِمْ مِمَّنْ هُوَ ضِدُّهُمْ ، إِذْ مَنْ دَعَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنْ يُنَجِّيَهُمْ مُؤْمِنُونَ مَظْلُومُونَ ، وَمَنْ كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدْعُو عَلَيْهِمْ بِاللَّعْنِ كُفَّارٌ وَمُنَافِقُونَ ظَالِمُونَ ، فَأَمَرَ اللَّهُ عَزَّ وَجَلَّ نَبِيَّهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِأَنْ يَتْرُكَ لَعْنَ مَنْ كَانَ يَلْعَنُهُمْ ، وَأَعْلَمَ أَنَّهُمْ ظَالِمُونَ ، وَأَنْ لَيْسَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ أَمْرِهِمْ شَيْءٌ ، وَأَنَّ اللَّهَ إِنْ شَاءَ عَذَّبَهُمْ أَوْ تَابَ عَلَيْهِمْ ، فَتَفَهَّمُوا مَا بَيَّنْتُهُ تَسْتَيْقِنُوا بِتَوْفِيقِ خَالِقِكُمْ غَلَطَ مَنِ احْتَجَّ بِهَذِهِ الأَخْبَارِ أَنَّ الْقُنُوتَ مِنْ صَلاةِ الْغَدَاةِ مَنْسُوخٌ بِهَذِهِ الآيَةِ
It is narrated from Sayyiduna Abdullah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) used to supplicate against four individuals, so Allah Almighty revealed this verse: « لَيْسَ لَكَ مِنَ الْأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] "O Prophet, you have no authority in this matter; Allah may accept their repentance or punish them, for they are wrongdoers." He says that Allah Almighty guided them to Islam. Imam Abu Bakr (may Allah have mercy on him) says that this hadith is also gharib (rare). Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) used to supplicate against some Arab tribes, so Allah Almighty revealed this verse: « لَيْسَ لَكَ مِنَ الْأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] "(O Prophet) you (peace and blessings be upon him) have no authority in this matter; Allah may accept their repentance or punish them, for they are wrongdoers." He says that then (Allah Almighty) guided them to Islam. Imam Abu Bakr (may Allah have mercy on him) says that these ahadith are evidence that cursing (the disbelievers) was abrogated with this verse, but the supplication which the Prophet (peace and blessings be upon him) used to make for the freedom of the Muslims imprisoned by the people of Makkah was not abrogated, that Allah Almighty grant those (weak Muslims) deliverance from them. Because it is not possible that this verse « أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] was revealed about those believers who were being oppressed by the disbelievers. Indeed, Allah Almighty revealed this verse « أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] concerning those disbelievers and hypocrites upon whom the Prophet (peace and blessings be upon him) used to invoke curses. Thus, Allah Almighty informed him that regarding those whom the Prophet (peace and blessings be upon him) curses in his supplication of Qunoot, the Prophet (peace and blessings be upon him) has no authority in their matter. And Allah Almighty informed him that if He wills, He may accept their repentance and guide them to Islam, or punish them due to their disbelief and hypocrisy, for they are wrongdoers in their state of disbelief and hypocrisy. This does not refer to those believing people for whom the Prophet (peace and blessings be upon him) used to supplicate that Allah Almighty grant them freedom from the oppression of the disbelievers. Therefore, Waleed bin Waleed, Salm bin Hisham, Ayyash bin Abi Rabee'ah, and the weak Muslims among the people of Makkah, for their deliverance from the captivity of the enemy disbelievers, the Prophet (peace and blessings be upon him) did not abandon supplicating for their freedom until their release from the captivity of the disbelievers of Makkah. He did not abandon supplicating for them due to the revelation of this verse, which was revealed about the disbelievers and hypocrites who were oppressors, not the oppressed. Have you not heard the hadith of Yahya bin Abi Katheer from Abu Salamah from Sayyiduna Abu Hurairah (may Allah be pleased with him), that one day the Prophet (peace and blessings be upon him) did not supplicate for them in the morning prayer, so I reminded him, and he (peace and blessings be upon him) said: "Do you not see that they (after gaining freedom) have come (to Madinah)?" "O Prophet, you have no authority in this matter; Allah may accept their repentance or punish them, for they are wrongdoers." He says that Allah Almighty guided them to Islam. Imam Abu Bakr (may Allah have mercy on him) says that this hadith is also gharib (rare). Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) used to supplicate against some Arab tribes, so Allah Almighty revealed this verse: « لَيْسَ لَكَ مِنَ الْأَمْرِ شَيْءٌ أَوْ يَتُوبَ عَلَيْهِمْ أَوْ يُعَذِّبَهُمْ فَإِنَّهُمْ ظَالِمُونَ » [ سورة آل عمران ] "O Prophet, you have no authority in this matter; Allah may accept their repentance or punish them, for they are wrongdoers." He says that then (Allah Almighty) guided them to Islam. Imam Abu Bakr (may Allah have mercy on him) says that these ahadith are evidence that with this verse, therefore, understand well what I have explained, and with the ability granted by your Creator and Master, be certain that whoever has deduced from these ahadith that making Qunoot in the morning prayer has been abrogated with this verse, his deduction is incorrect.
