Hadith 34

وَسَمِعْتُ مُحَمَّدَ بْنَ يَحْيَى ، يَقُولُ : نَرَى الْوُضُوءَ مِنْ مَسِّ الذَّكَرِ اسْتِحْبَابًا لا إِيجَابًا بِحَدِيثِ عَبْدِ اللَّهِ بْنِ بَدْرٍ ، عَنْ قَيْسِ بْنِ طَلْقٍ ، عَنْ أَبِيهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . قَالَ أَبُو بَكْرٍ : وَكَانَ الشَّافِعِيُّ رَحِمَهُ اللَّهُ يُوجِبُ الْوُضُوءَ مِنْ مَسِّ الذَّكَرِ ، اتِّبَاعًا بِخَبَرِ بُسْرَةَ بِنْتِ صَفْوَانَ لا قِيَاسًا ، قَالَ أَبُو بَكْرٍ : وَبِقَوْلِ الشَّافِعِيِّ أَقُولُ ، لأَنَّ عُرْوَةَ قَدْ سَمِعَ خَبَرَ بُسْرَةَ مِنْهَا ، لا كَمَا تَوَهَّمَ بَعْضُ عُلَمَائِنَا أَنَّ الْخَبَرَ وَاهٍ لِطَعْنِهِ فِي مَرْوَانَ
Imam Abu Bakr, may Allah have mercy on him, says that I heard Muhammad bin Yahya saying, "According to us, due to the hadith of Sayyiduna Talq, may Allah be pleased with him, performing ablution after touching the private part is recommended, not obligatory." Imam Abu Bakr, may Allah have mercy on him, says that Imam Shafi’i, may Allah have mercy on him, instead of making analogy, used to declare ablution obligatory after touching the private part by following the hadith of Sayyida Busrah bint Safwan, may Allah be pleased with her. Imam Abu Bakr, may Allah have mercy on him, says that I also hold the same position as Imam Shafi’i, may Allah have mercy on him, because Hazrat Urwah heard this hadith from Sayyida Busrah, may Allah be pleased with her—contrary to the misconception of some scholars who say that this hadith is weak due to criticism of Marwan.

Explanation & Benefits

Benefits:

➊ Touching the private part without any barrier or covering breaks ablution (wudu). Thus, it is narrated from Abu Hurairah radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam said:

«اذا أَفْضَى أَحَدُكُمْ بِيَدِهِ إِلَى فَرْجِهِ، وَلَيْسَ بِيْنَهُمَا سِتْرَ وَلَا حِجَابٌ فَلْيَتَوَضَّأُ»

“When any one of you lets his hand reach his private part and there is no barrier or covering between his hand and his private part, then he should perform ablution (wudu).” [ابن حبان: 1118، بيهقي: 1/ 133، دار قطني: 53، اسناده صحيح]

➋ Men and women are equal in this ruling. It is narrated from Abdullah ibn Amr ibn al-As that the Prophet sallallahu alayhi wa sallam said:

«أَيْمَا رَجُلٍ مَسَّ فَرْجَهُ فَلْيَتَوَضَّا، وَأَيُّمَا امْرَأَةٍ مَسَّتْ فَرْجَهَا فَلْتَتَوَضًا»

“Whoever among the men touches his private part, let him perform ablution (wudu), and whoever among the women touches her private part, let her perform ablution (wudu).”

➌ Ablution (wudu) is also broken by touching the private part of a small child. Thus, the Saudi Fatwa Committee has issued a fatwa that touching the private part without any barrier or covering breaks ablution (wudu), whether the private part touched belongs to a child or an adult, because the statement of the Prophet sallallahu alayhi wa sallam is: Whoever touches his private part, let him perform ablution (wudu). Also, the ruling of touching someone else’s private part is the same as touching one’s own private part. [فتاوي اللجنة الدائمة للبحوث العلمية والافتاء: 251/7]
