(432) بَابُ إِبَاحَةِ الْعُمْرَةِ فِي أَشْهُرِ الْحَجِّ لِمَنْ لَا يَحُجُّ عَامَهُ ذَلِكَ، وَالرُّخْصَةِ لَهُ فِي الرُّجُوعِ إِلَى وَطَنِهِ بَعْدَ قَضَاءِ الْعُمْرَةِ قَبْلَ [أَنْ] يَحُجَّPermissibility of performing Umrah during the months of Hajj for those not performing Hajj that year, and permission to return home after Umrah before Hajj.
Hadith 3079
حَدَّثَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ ، وَبَحْرُ بْنُ نَصْرٍ ، قَالا : حَدَّثَنَا ابْنُ وَهْبٍ ، أَخْبَرَنَا ابْنُ أَبِي الزِّنَادِ ، عَنْ عَلْقَمَةَ وَهُوَ ابْنُ أَبِي عَلْقَمَةَ ، عَنْ أُمِّهِ ، عَنْ عَائِشَةَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَمَرَ النَّاسَ عَامَ حَجَّةِ الْوَدَاعِ ، فَقَالَ : " مَنْ أَحَبَّ أَنْ يَرْجِعَ بِعُمْرَةٍ قَبْلَ الْحَجِّ ، فَلْيَفْعَلْ " ، قَالَ أَبُو بَكْرٍ : هَذَا الْخَبَرُ يُصَرِّحُ بِصِحَّةِ قَوْلِ الْمُطَّلِبِيِّ : أَنَّ فَرْضَ الْحَجِّ مَمْدُودٌ مِنْ حِينِ يَجِبُ عَلَى الْمَوَالِي أَنْ تَحْدُثَ بِهِ الْمَنِيَّةُ ، إِذْ لَوْ كَانَ فَرْضُ الْحَجِّ عَلَى مَا تَوَهَّمَهُ بَعْضُ مَنْ لا يَفْهَمُ الْعِلْمَ ، وَزَعَمَ أَنَّ مَنْ . . . . . . الْحَجِّ عَنْ أَوَّلِ سَنَةٍ يَجِبُ عَلَيْهِ الْحَجُّ كَانَ فِيهَا عَاصِيًا لِلَّهِ لَمَا أَبَاحَ الْمُصْطَفي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِمَنْ كَانَ مَعَهُ عَامَ حَجَّةِ الْوَدَاعِ أَنْ يَرْجِعَ بِعُمْرَةٍ قَبْلَ أَنْ يَحُجَّ وَبَيْنَهُمْ وَبَيْنَ الْحَجِّ أَيَّامٌ قَلائِلُ ، لأَنَّ الْمُصْطَفي صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ دَخَلَ مَكَّةَ فِي حَجَّةِ الْوَدَاعِ لأَرْبَعٍ مَضَيْنَ مِنْ ذِي الْحِجَّةِ ، وَبَيْنَهُمْ وَبَيْنَ عَرَفَةَ خَمْسَةُ أَيَّامٍ ، فَأَبَاحَ لِمَنْ أَحَبَّ الرُّجُوعَ بَعْدَ الْفَرَاغِ مِنَ الْعُمْرَةِ أَنْ يَرْجِعَ قَبْلَ أَنْ يَحُجَّ
Lady Aisha (may Allah be pleased with her) narrates that the Messenger of Allah (peace and blessings be upon him) gave an order to the people in the year of the Farewell Hajj and said: "Whoever wishes to return after performing only Umrah before Hajj may do so." Imam Abu Bakr (may Allah have mercy on him) says that this narration is evidence for the correctness of Imam Shafi'i's (may Allah have mercy on him) opinion that the time for Hajj is broad. A person can perform Hajj after it becomes obligatory upon him, at any time before his death. Because if it were necessary to perform it in the same year it became obligatory, as some less knowledgeable people think, then the one who delays Hajj would be considered disobedient to Allah. However, the Noble Prophet (peace and blessings be upon him) gave his companions permission during the Farewell Hajj that whoever wishes to return to his homeland after performing only Umrah before Hajj may do so, and at that time only a few days were left for Hajj, because the Noble Prophet (peace and blessings be upon him) entered Makkah Mukarramah for the Farewell Hajj on the 4th of Dhul-Hijjah, and only five days were left for Hajj. But even then, he gave permission to those who wanted to return after performing Umrah that whoever wishes to return after performing Umrah before me may do so.
