أَبِي ظَبْيَانَ ، عَنِ
ابْنِ عَبَّاسٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا حَجَّ الصَّبِيُّ فَهِيَ لَهُ حَجَّةٌ حَتَّى يَعْقِلَ ، فَإِذَا عَقَلَ فَعَلَيْهِ حَجَّةٌ أُخْرَى ، وَإِذَا حَجَّ الأَعْرَابِيُّ فَهِيَ لَهُ حَجَّةٌ ، فَإِذَا هَاجَرَ فَعَلَيْهِ حَجَّةٌ أُخْرَى " ، أَخْبَرَنِي

أَبِي ظَبْيَانَ ، عَنِ
ابْنِ عَبَّاسٍ ، بِمِثْلِهِ مَوْقُوفًا ، قَالَ أَبُو بَكْرٍ : هَذَا عِلْمِي هُوَ الصَّحِيحُ بِلا شَكٍّ ، قَالَ أَبُو بَكْرٍ : هَذِهِ اللَّفْظَةُ : وَإِذَا حَجَّ الأَعْرَابِيُّ مِنَ الْجِنْسِ الَّتِي كُنْتُ أَقُولُ إِنَّهُ فِي بَعْضِ الأَوْقَاتِ دُونَ جَمِيعِ الأَوْقَاتِ ، وَهَذِهِ اللَّفْظَةُ إِنْ صَحَّتْ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَإِنَّمَا كَانَ هَذَا الْحُكْمُ قَبْلَ فَتْحِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَكَّةَ ، فَلَمَّا فَتَحَهَا ، وَخَبَّرَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ لا هِجْرَةَ بَعْدَ الْفَتْحِ اسْتَوَى الأَعْرَابِيُّ وَالْمُهَاجِرُ فِي الْحَجِّ ، فَجَازَ عَنِ الأَعْرَابِيِّ إِذَا حَجَّ كَمَا يَجُوزُ عَنِ الْمُهَاجِرِ لِسُقُوطِ الْهِجْرَةِ ، وَبُطْلانِهَا بَعْدَ فَتْحِ مَكَّةَ
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: "When a child performs Hajj, that Hajj is sufficient for him until he reaches puberty. Then, when he becomes mature, he will have to perform Hajj again. And when a Bedouin performs Hajj, that is his Hajj, but when he migrates (to Madinah Munawwarah), then Hajj becomes obligatory upon him again." Abu Zubyan narrates a similar mawquf hadith from Sayyiduna Ibn Abbas (may Allah be pleased with them both). Imam Abu Bakr (may Allah have mercy on him) says that, to my knowledge, this mawquf hadith (the personal statement of Sayyiduna Ibn Abbas, may Allah be pleased with them both) is authentic, and there is no doubt in it. Imam Abu Bakr (may Allah have mercy on him) says that these words, that when a Bedouin performs Hajj (then his Hajj will suffice him until he migrates, and after migrating he will have to perform Hajj again), this issue is of the same kind about which I say that the ruling is for certain times, not for all times. If these words are proven from the Noble Prophet (peace and blessings be upon him), then this ruling is for before the conquest of Makkah. Then, when you conquered Makkah and made it clear that after the conquest of Makkah there is no need for migration, then in the ruling of Hajj, the Bedouin and the Muhajir became equal. Therefore, when a Bedouin performs Hajj, it will suffice him just as it suffices the Muhajir. Because after the conquest of Makkah, the ruling of migration has ended.
