Hadith 3048

حَدَّثَنَا يُونُسُ بْنُ عَبْدِ الأَعْلَى ، وَمُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْحَكَمِ ، قَالا : حَدَّثَنَا ابْنُ وَهْبٍ ، أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ ، عَنْ سُلَيْمَانَ بْنِ مِهْرَانَ ، عَنْ أَبِي ضَبْيَانَ ، عَنِ ابْنِ عَبَّاسٍ ، قَالَ : مَرَّ عَلِيُّ بْنُ أَبِي طَالِبٍ بِمَجْنُونَةِ بَنِي فُلانٍ قَدْ زَنَتْ ، أَمَرَ عُمَرُ بِرَجْمِهَا ، فَرَدَّهَا عَلِيٌّ ، وَقَالَ لِعُمَرَ : يَا أَمِيرُ الْمُؤْمِنِينَ ، أَتَرْجِمُ هَذِهِ ؟ قَالَ : نَعَمْ ، قَالَ : أَمَا تَذْكُرُ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " رُفِعَ الْقَلَمُ عَنْ ثَلاثَةٍ : عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ ، وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ " ، قَالَ : صَدَقْتَ ، فَخَلَّى عَنْهَا ، قَالَ أَبُو بَكْرٍ : وَفِيهِ دَلِيلٌ عِنْدِي عَلَى أَنَّ الْمَجْنُونَ إِذَا حُجَّ بِهِ فِي حَالِ جُنُونِهِ ، ثُمَّ أَفَاقَ لَمْ يُجِزْهُ كَالصَّبِيِّ
Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates that Sayyiduna Ali (may Allah be pleased with him) passed by a mad woman from a certain tribe who had committed adultery, and Sayyiduna Umar (may Allah be pleased with him) had ordered her to be stoned. Sayyiduna Ali (may Allah be pleased with him) sent the woman back and said to Sayyiduna Umar (may Allah be pleased with him), "O Commander of the Faithful, do you want to stone this woman?" He replied, "Yes." Sayyiduna Ali (may Allah be pleased with him) submitted, "Do you not remember that the Messenger of Allah (peace and blessings be upon him) said: 'The pen has been lifted from three types of people: the insane person whose mind and understanding are gone until he regains sanity, the sleeping person until he wakes up, and the child until he reaches puberty.'" Sayyiduna Umar (may Allah be pleased with him) said, "You have spoken the truth." Then the woman was released. Imam Abu Bakr (may Allah have mercy on him) says that in my view, this hadith is evidence that if an insane person performs Hajj in the state of insanity and then regains sanity, that Hajj will not suffice for him. Just as the Hajj performed by a child before reaching puberty does not suffice for the obligatory Hajj.
