ثنا مُحَمَّدُ بْنُ رَافِعٍ ، ثنا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ سَالِمٍ ، عَنِ ابْنِ عُمَرَ ، عَنْ
عُمَرَ ، قَالَ: " إِذَا رَمَى الرَّجُلُ الْجَمْرَةَ بِسَبْعِ حَصَيَاتٍ ، وَذَبَحَ وَحَلَقَ ، فَقَدْ حَلَّ لَهُ كُلُّ شَيْءٍ ، إِلا النِّسَاءَ وَالطِّيبَ " . قَالَ قَالَ
سَالِمٌ : وَكَانَتْ
عَائِشَةُ ، تَقُولُ: " قَدْ حَلَّ لَهُ كُلُّ شَيْءٍ ، إِلا النِّسَاءَ " ، وَقَالَتْ: " طَيَّبْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " ، قَالَ أَبُو بَكْرٍ: فِي إِخْبَارِ عَائِشَةَ: طَيَّبْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِحِلِّهِ قَبْلَ أَنْ يَطُوفَ بِالْبَيْتِ ، دَلالَةٌ عَلَى أَنَّهُ إِذَا رَمَى الْجَمْرَةَ وَذَبَحَ وَحَلَقَ كَانَ حَلالا قَبْلَ أَنْ يَطُوفَ بِالْبَيْتِ ، خَلا مَا زُجِرَ عَنْهُ مِنْ وَطْءِ النِّسَاءِ الَّذِي لَمْ يَخْتَلِفِ الْعُلَمَاءُ فِيهِ أَنَّهُ مَمْنُوعٌ مِنْ وَطْءِ النِّسَاءِ حَتَّى يَطُوفَ طَوَافَ الزِّيَارَةِ .
Sayyiduna Umar (may Allah be pleased with him) narrates that when a pilgrim has stoned the Jamrah ‘Aqabah, shaved his head, and slaughtered the sacrifice, then everything becomes lawful for him except perfume and intercourse with his wife. Sayyiduna Salim says that Sayyidah Aisha (may Allah be pleased with her) says: then everything becomes lawful for him except intercourse with his wife. And she said: I applied perfume to the Messenger of Allah (peace and blessings be upon him) (before the Tawaf al-Ziyarah). Imam Abu Bakr (may Allah have mercy on him) says that in the narration of Sayyidah Aisha (may Allah be pleased with her), it is mentioned: I applied perfume to the Messenger of Allah (peace and blessings be upon him) before the Tawaf al-Ziyarah at the time of removing Ihram. This is evidence that when he had stoned the Jamrah ‘Aqabah, slaughtered the sacrifice, and shaved his head, he had removed the Ihram before performing the Tawaf al-Ziyarah. Only intercourse with the wife was prohibited, because the scholars are unanimous that intercourse with the wife before Tawaf al-Ziyarah is prohibited.
