وَرُوِيَ عَنِ ابْنِ مَسْعُودٍ ، " فَلَمْ يَزَلْ يُلَبِّي حَتَّى رَمَى جَمْرَةَ الْعَقَبَةِ بِأَوَّلِ حَصَاةٍ " ، ثَنَاهُ
عَلِيُّ بْنُ حُجْرٍ ، أَخْبَرَنَا

أَبِي وَائِلٍ ، عَنْ
عَبْدِ اللَّهِ ، قَالَ : " رَمَقْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يَزَلْ يُلَبِّي حَتَّى رَمَى جَمْرَةَ الْعَقَبَةِ بِأَوَّلِ حَصَاةٍ " ، قَالَ أَبُو بَكْرٍ : وَلَعَلَّهُ يَخْطِرُ بِبَالِ بَعْضِ الْعُلَمَاءِ أَنَّ فِيَ هَذَا الْخَبَرِ دَلالَةٌ عَلَى أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقْطَعُ التَّلْبِيَةَ عِنْدَ أَوَّلِ حَصَاةٍ يَرْمِيهَا مِنْ جَمْرَةِ الْعَقَبَةِ ، وَهَذَا عِنْدِي مِنَ الْجِنْسِ الَّذِي أَعْلَمْتُ فِي غَيْرِ مَوْضِعٍ مِنْ كِتَابِنَا أَنَّ الأَمْرَ قَدْ يَكُونُ إِلَى وَقْتٍ مُؤَقَّتٍ فِي الْخَبَرِ ، وَالزَّجْرُ يَكُونُ إِلَى وَقْتٍ مُؤَقَّتٍ فِي الْخَبَرِ ، وَلا يَكُونُ فِي ذِكْرِ الْوَقْتِ مَا يَدُلُّ عَلَى أَنَّ الأَمْرَ بَعْدَ ذَلِكَ الْوَقْتِ سَاقِطٌ ، وَلا أَنَّ الزَّجْرَ بَعْدَ ذَلِكَ الْوَقْتِ سَاقِطٌ ، كَزَجْرِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الصَّلاةِ بَعْدَ الصَّلاةِ حَتَّى تَطْلُعَ الشَّمْسُ ، فَلَمْ يَكُنْ فِي قَوْلِهِ دَلالَةٌ عَلَى أَنَّ الشَّمْسَ إِذَا طَلَعَتْ فَالصَّلاةُ جَائِزَةٌ عِنْدَ طُلُوعِهَا ، إِذِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ زَجَرَ أَنْ يُتَحَرَّى بِالصَّلاةِ طُلُوعُ الشَّمْسِ وَغُرُوبُهَا ، وَالنَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ أَعْلَمَ أَنَّ الشَّمْسَ تَطْلُعُ بَيْنَ قَرْنَيْ شَيْطَانٍ ، فَزَجَرَ عَنِ الصَّلاةِ عِنْدَ طُلُوعِ الشَّمْسِ ، وَقَالَ : وَإِذَا ارْتَفَعَتْ فَارِقْهَا ، فَدَلَّهُمْ بِهَذِهِ الْمُخَاطَبَةِ أَنَّ الصَّلاةَ عِنْدَ طُلُوعِهَا غَيْرُ جَائِزَةٍ حَتَّى تَرْتَفِعَ الشَّمْسُ ، وَقَدْ أَمْلَيْتُ مِنْ هَذَا الْجِنْسِ مَسَائِلَ كَثِيرَةً فِي الْكُتُبِ الْمُصَنَّفَةِ ، وَالدَّلِيلُ عَلَى صِحَّةِ هَذَا التَّأْوِيلِ الْحَدِيثُ الْمُصَرِّحُ الَّذِي حَدَّثْنَاهُ
It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he continued to recite the Talbiyah until he threw the first pebble at the Jamrah. Sayyiduna Abdullah (may Allah be pleased with him) states that I saw the Noble Prophet (peace and blessings be upon him) reciting the Talbiyah continuously until he threw the first pebble at Jamrah Aqabah. Imam Abu Bakr (may Allah have mercy on him) says that perhaps some scholars may think that this hadith contains evidence that the Prophet (peace and blessings be upon him) would stop reciting the Talbiyah upon throwing the first pebble at Jamrah Aqabah. This issue, in my view, is of the same kind as I have mentioned in several places in my books: sometimes, in a narration, a ruling is specified up to a certain time, and the prohibition of an act is also specified up to a certain time. However, specifying the time does not mean that the ruling or prohibition ends after that time. For example, the Noble Prophet (peace and blessings be upon him) forbade performing prayer after the Fajr prayer until the sun rises. But in this statement, there is no evidence that it becomes permissible to pray as soon as the sun rises. And he has explained that the sun rises between the two horns of Satan, so he forbade praying at the time of sunrise. And he said that when the sun rises high, Satan separates from the sun. In this way, he stated that it is not permissible to pray at the time of sunrise until the sun has risen high, then it is permissible. I have written many such issues in my books. The evidence for the correctness of my interpretation is the following hadith which we have mentioned.
