يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ ،

هُشَيْمٌ ، أَخْبَرَنِي
ابْنُ أَبِي لَيْلَى ، قَالَ مُحَمَّدُ بْنُ هِشَامٍ: عَنِ ابْنِ أَبِي لَيْلَى ، قَالَ أَبُو بَكْرٍ: فَلَمَّا تَدَبَّرْتُ خَبَرَ عُبَيْدِ بْنِ حُنَيْنٍ كَانَ فِيهِ مَا دَلَّ عَلَى أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ كَانَ يَقْطَعُ التَّلْبِيَةَ عِنْدَ دُخُولِ عُرُوشِ مَكَّةَ ، وَخَبَرُ عُبَيْدِ بْنِ حُنَيْنٍ أَثْبَتُ إِسْنَادًا مِنْ خَبَرِ عَطَاءٍ ؛ لأَنَّ ابْنَ أَبِي لَيْلَى لَيْسَ بِالْحَافِظِ ، وَإِنْ كَانَ فَقِيهًا عَالِمًا ، فَأَرَى لِلْمُحْرِمِ كَانَ بِحَجٍّ أَوْ عُمْرَةٍ أَوْ بِهِمَا جَمِيعًا قَطْعَ التَّلْبِيَةِ عِنْدَ دُخُولِ عُرُوشِ مَكَّةَ ، فَإِنْ كَانَ مُعْتَمِرًا لَمْ يَعُدْ إِلَى التَّلْبِيَةِ ، وَإِنْ كَانَ مُفْرَدًا أَوْ قَارِنًا عَادَ إِلَى التَّلْبِيَةِ عِنْدَ فَرَاغِهِ مِنَ السَّعْيِ بَيْنَ الصَّفَا وَالْمَرْوَةِ ، لأَنَّ فِعْلَ ابْنِ عُمَرَ كَالدَّالِ عَلَى أَنَّهُ رَأَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَطَعَ التَّلْبِيَةَ فِي حَجَّتِهِ إِلَى الْفَرَاغِ مِنَ السَّعْيِ بَيْنَ الصَّفَا وَالْمَرْوَةِ . ¤ حَدَّثَنَاهُ حَدَّثَنَاهُ الرَّبِيعُ بْنُ سُلَيْمَانَ ، حَدَّثَنَا بِشْرُ بْنُ بَكْرٍ ، عَنِ الأَوْزَاعِيِّ ، قَالَ: قَالَ عَطَاءُ بْنُ أَبِي رَبَاحٍ: كَانَ
ابْنُ عُمَرَ يَدَعُ التَّلْبِيَةَ إِذَا دَخَلَ الْحَرَمَ ، وَيُرَاجِعَهَا بَعْدَ مَا يَقْضِي طَوَافَهُ بَيْنَ الصَّفَا وَالْمَرْوَةِ .
The Imam has mentioned the chain of narration for the above-mentioned report. Imam Abu Bakr (may Allah have mercy on him) says that when I pondered over the narration of Ubaid bin Hunaīn, I found in it the evidence that the Prophet Muhammad (peace be upon him) would stop saying the Talbiyah as soon as he entered the populated area of Makkah Mukarramah. The narration of Ubaid bin Hunaīn is stronger in terms of chain of narration than the narration of Imam Ata, because Ibn Abi Layla is not a memorizer of hadith, although he is a proficient jurist and scholar of religion. Therefore, my position now is that whether the Muhrim comes for Hajj or for Umrah, he will stop saying the Talbiyah as soon as he enters the populated area of Makkah Mukarramah. And if he has come only for Umrah, he will not recite the Talbiyah again. And if he is performing Hajj Mufrad or Hajj Qiran, then after performing the Sa’i of Safa and Marwah, he will start reciting the Talbiyah again. Because the action of Sayyiduna Ibn Umar (may Allah be pleased with them both) is evidence that he saw the Prophet Muhammad (peace be upon him) stop saying the Talbiyah during his Hajj until the Sa’i of Safa and Marwah. Imam Ata bin Abi Rabah (may Allah have mercy on him) narrates that Sayyiduna Ibn Umar (may Allah be pleased with them both) would stop saying the Talbiyah after entering the boundaries of the Haram, and after performing the Sa’i of Safa and Marwah, he would start reciting the Talbiyah again.
