(172) بَابُ ذِكْرِ أَوَّلِ صَدَقَةٍ مُحْبَسَةٍ تُصُدِّقَ بِهَا فِي الْإِسْلَامِ، وَأشْرَاطِ الْمُتَصَدِّقِ صَدَقَةَ الْمَحْرُمَةِ حَبْسَ أُصُولِ الصَّدَقَةِ وَالْمَنْعِ مِنْ بَيْعِ رِقَابِهَا وَهِبَتِهَا وَتَوْرِيثِهَا، وَتَسْبِيلِ مَنَافِعِهَا وَغَلَّاتِهَا عَلَى الْفُقَرَاءِ، وَالْقُرْبَى، وَالرِّقَابِ، وَفِي سَبِيلِ اللَّهِ، وَابْنِ السَّبِيلِ، وَالضَّعِيفِ
172 Subchapter: First endowment (waqf) charity in Islam, and its conditions: keeping the principal, forbidding sale, gift, or inheritance, and dedicating its benefit to the poor, relatives, freeing slaves, in Allah’s cause, travelers, and the weak

أَبُو مُوسَى مُحَمَّدُ بْنُ الْمُثَنَّى ، حَدَّثَنَا
ابْنُ أَبِي عَدِيٍّ ، عَنِ
ابْنِ عَوْنٍ ، عَنْ
نَافِعٍ ، عَنِ
ابْنِ عُمَرَ : أَنَّ عُمَرَ أَصَابَ أَرْضًا بِخَيْبَرَ ، فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِيَسْتَأْمِرَ فِيهَا ، قَالَ : إِنِّي أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالا قَطُّ أَنْفَسَ عِنْدِي مِنْهُ ، فَمَا تَأْمُرُ بِهِ ، قَالَ : " إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا ، وَتَصَدَّقْتَ بِهَا " ، قَالَ : فَتَصَدَّقَ بِهَا عُمَرُ أَنْ لا تُبَاعَ , أُصُولُهَا لا تُبَاعُ ، وَلا تُوهَبُ ، وَلا تُوَرَّثُ ، فَتَصَدَّقَ بِهَا عَلَى الْفُقَرَاءِ ، وَالْقُرْبَى ، وَالرِّقَابِ ، وَفِي سَبِيلِ اللَّهِ ، وَابْنِ السَّبِيلِ وَالضَّعِيفِ ، لا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ مِنْهَا بِالْمَعْرُوفِ ، أَوْ يُطْعِمُ صَدِيقًا غَيْرَ مُتَمَوِّلٍ فِيهَا ، قَالَ ابْنُ عَوْنٍ : فَحَدَّثْتُ بِهِ مُحَمَّدًا ، فَقَالَ : غَيْرُ مُتَأَمِّلٍ مَالا ، قَالَ ابْنُ عَوْنٍ : وَحَدَّثَنِي مَنْ قَرَأَ الْكِتَابَ : غَيْرُ مُتَأَثِّلٍ مَالا . قَالَ أَبُو بَكْرٍ : وَرَوَى عَبْدُ اللَّهِ بْنُ عُمَرَ الْعُمَرِيُّ ، أَنَّ نَافِعًا ، حَدَّثَهُمْ قَالَ : سَمِعْتُ ابْنَ عُمَرَ ، يَقُولُ : أَوَّلُ صَدَقَةٍ تُصُدِّقَ بِهَا فِي الإِسْلامِ صَدَقَةُ عُمَرَ بْنِ الْخَطَّابِ ، وَأَنَّ عُمَرَ ، قَالَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِنّ لِي مَالا , وَأَنَا أُرِيدُ أَنْ أَتَصَدَّقَ بِهِ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " احْبِسْ أَصْلَهُ ، وَسَبِّلْ تَمْرَهُ " ، قَالَ : فَكَتَبَ حَدَّثَنَا يُونُسُ ، أَخْبَرَنَا ابْنُ وَهْبٍ ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ عُمَرَ
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) received some land and gardens in Khaybar, so he came to the service of the Noble Prophet (peace and blessings be upon him) to consult about it. He says: I have never received any wealth as valuable as the land I have acquired in Khaybar, so what do you command me regarding it? The Prophet (peace and blessings be upon him) said: "If you wish, keep the original ownership of the land with yourself and give its benefits and produce as charity." Sayyiduna Ibn Umar (may Allah be pleased with them both) says that Sayyiduna Umar (may Allah be pleased with him) gave that land as charity on the condition that its original (property) would neither be sold, nor gifted, nor inherited. He gave its benefits and produce as charity for the poor relatives, for freeing slaves, for the warriors in the path of Allah, for travelers, and for the weak. Whoever supervises it may eat from it in a reasonable manner and may feed his friends as well, but he should not be one who accumulates wealth (i.e., does not make it his own property). Ibn Awn says: I narrated this tradition to Muhammad, and he said: "ghayra muta’ammil mālan"—he should not be desirous and hopeful of wealth. Ibn Awn says: A person who reads the book narrated to me the words "ghayra muta’aththil mālan"—he should not be one who accumulates wealth. Imam Abu Bakr (may Allah have mercy on him) says that Abdullah Umar al-Umari narrated from Imam Nafi’ from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the first endowment (waqf) in Islam was the charity of Sayyiduna Umar ibn Khattab (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) submitted to the Messenger of Allah (peace and blessings be upon him) that indeed I have some wealth and I wish to give it in charity. So the Messenger of Allah (peace and blessings be upon him) said: "Keep its original in your ownership and give its fruits and produce in charity." Thus, Sayyiduna Umar (may Allah be pleased with him) wrote this endowment deed.
