Hadith 2465

وَالدَّلِيلُ عَلَى أَنَّ الصَّدَقَةَ إِذَا رَجَعَتْ إِلَى الْمُتَصَدِّقِ بِهَا إِرْثًا عَنِ الْمُتَصَدَّقِ عَلَيْهِ جَازَ لَهُ‏.‏ وَالْفَرْقُ بَيْنَ مَا يَمْلِكُهُ الرَّجُلُ مِنَ الصَّدَقَةِ إِرْثًا وَبَيْنَ مَا يَمْلِكُهُ بِابْتِيَاعٍ أَوِ اسْتِيهَابٍ، إِذِ الْإِرْثُ يَمْلِكُهُ الْوَارِثُ أَحَبَّ ذَلِكَ أَمْ كَرِهَ، وَلَا يَمْلِكُ الْمَرْءُ مِلْكًا بِغَيْرِ نِيَّةٍ، وَأَخْبَرَ أَنَّهُ مِلْكٌ بِمَعْنَى مِنَ الْمَعَانِي سِوَى الْمِيرَاثِ‏.‏
And the evidence that charity, if it returns to the giver as inheritance from the one to whom it was given, is permissible for him. And the difference between what a man owns of charity as inheritance and what he owns by purchase or as a gift: inheritance is owned by the heir whether he likes it or dislikes it, and a person does not own something without intention, and it was stated that it is ownership in a sense other than inheritance.
حَدَّثَنَا مُوسَى بْنُ عَبْدِ الرَّحْمَنِ الْمَسْرُوقِيُّ ، حَدَّثَنَا أَبُو أُسَامَةَ ، عَنْ حُسَيْنٍ وَهُوَ الْمُعَلِّمُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ : أَنَّ رَجُلا تَصَدَّقَ عَلَى وَلَدِهِ بِأَرْضٍ ، فَرَدَّهَا إِلَيْهِ الْمِيرَاثُ ، فَذَكَرَ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ لَهُ : " وَجَبَ أَجْرُكَ ، وَرَجَعَ إِلَيْكَ مِلْكُكَ "
It is narrated from Sayyiduna Amr bin Al-Aas (may Allah be pleased with him) that a man gave a garden in charity to his son. (That boy passed away), so the garden returned to the man as inheritance. He informed the Messenger of Allah (peace and blessings be upon him) about this, so the Prophet (peace and blessings be upon him) said to him: "Your reward is established, and your ownership has also returned to you."
