Hadith 1932

حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ ، حَدَّثَنَا حَفْصٌ يَعْنِي ابْنَ غِيَاثٍ . ح وَحَدَّثَنَا بُنْدَارٌ ، نا يَحْيَى ، جَمِيعًا عَنْ عُبَيْدِ اللَّهِ ، قَالَ : سَمِعْتُ الْقَاسِمَ ، عَنْ عَائِشَةَ ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِنَّ بِلالا يُؤَذِّنُ بِلَيْلٍ , فَكُلُوا وَاشْرَبُوا حَتَّى يُؤَذِّنَ ابْنُ أُمِّ مَكْتُومٍ " . قَالَ : وَلَمْ يَكُنْ بَيْنَهُمَا إِلا قَدْرُ مَا يَنْزِلُ هَذَا , وَيَرْقَى هَذَا . وَقَالَ الدَّوْرَقِيُّ : عَنْ قَاسِمٍ , وَقَالَ أَيْضًا : " إِذَا أَذَّنَ بِلالٌ فَكُلُوا وَاشْرَبُوا حَتَّى يُؤَذِّنَ ابْنُ أُمِّ مَكْتُومٍ " . قَالَ : وَلَمْ يَكُنْ بَيْنَهُمَا إِلا أَنْ يَنْزِلَ هَذَا , وَيَصْعَدَ هَذَا . قَالَ أَبُو بَكْرٍ : هَذَا الْخَبَرُ مِنَ الْجِنْسِ الَّذِي أَقُولُ مِنَ الأَخْبَارِ الْمُعَلِّلَةِ الَّتِي يَجُوزُ الْقِيَاسُ عَلَيْهَا , وَيَتَعَيَّنُ الْعِلْمُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمَّا أَمَرَ بِالأَكْلِ وَالشُّرْبِ بَعْدَ نِدَاءِ بِلالٍ أَعْلَمَهُمْ أَنَّ الْجِمَاعَ وَكُلَّ مَا جَازَ لِلْمُفْطِرِ فَجَائِزٌ فِعْلُهُ فِي ذَلِكَ الْوَقْتِ , لا أَنَّهُ أَبَاحَ الأَكْلَ وَالشُّرْبَ فَقَطْ دُونَ غَيْرِهِمَا
Lady Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Indeed, Bilal (may Allah be pleased with him) gives the call to prayer at night, so eat and drink (for suhoor) until Ibn Umm Maktum (may Allah be pleased with him) gives the call to prayer." And he said that the interval between the two calls to prayer was only as long as it took for one to descend after giving the call and the other to ascend. And in the narration of Al-Dawraqi from Qasim, these words are mentioned: "When Bilal gives the call to prayer, then eat and drink until Ibn Umm Maktum (may Allah be pleased with him) gives the call to prayer." And the interval between their two calls to prayer was only as long as it took for one to descend after giving the call and the other to ascend. Imam Abu Bakr (may Allah have mercy on him) says that this narration is of the kind about which I say that it contains such reasons upon which analogy is permissible. And it is certain that when the Noble Prophet (peace and blessings be upon him) permitted eating and drinking after the call to prayer of Sayyiduna Bilal (may Allah be pleased with him), he informed them that at that time, intercourse and every act permissible for a non-fasting person is allowed. It is not that the Prophet (peace and blessings be upon him) only permitted eating and drinking and prohibited other things.
