(612) بَابُ إِبَاحَةِ دُخُولِ عَبِيدِ الْمُشْرِكِينَ وَأَهْلِ الذِّمَّةِ الْمَسْجِدَ وَالْمَسْجِدَ الْحَرَامَ أَيْضًاThe chapter on the permissibility of slaves of non-Muslims and People of the Book entering mosques, including the Sacred Mosque
Hadith 1329
نَا مُحَمَّدُ بْنُ يَحْيَى ، نَا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنَا ابْنُ جُرَيْجٍ ، أَخْبَرَنِي أَبُو الزُّبَيْرِ ، أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ ، يَقُولُ فِي قَوْلِهِ تَعَالَى : إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلا يَقْرَبُوا الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَذَا سورة التوبة آية 28 قَالَ : " إِلا أَنْ يَكُونَ عَبْدًا أَوْ أَحَدًا مِنْ أَهْلِ الذِّمَّةِ "
Abu Zubair narrates that he heard Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) explaining the statement of Allah Almighty « إِنَّمَا الْمُشْرِكُونَ نَجَسٌ فَلَا يَقْرَبُوا الْمَسْجِدَ الْحَرَامَ بَعْدَ عَامِهِمْ هَٰذَا » [ سورۃ التوبه : 28 ] "Indeed, the polytheists are impure, so let them not approach Al-Masjid Al-Haram after this year," he said: Except if he is a slave or a person from the people under protection (Ahl al-Dhimma), (then he may enter Al-Masjid Al-Haram).
