(573) بَابُ ذِكْرِ الدَّلِيلِ عَلَى أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا أَرَادَ بِقَوْلِهِ: لَا صَلَاةَ بَعْدَ الصُّبْحِ حَتَّى تَطْلُعَ الشَّمْسُ، وَلَا بَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ بَعْضَ صَلَاةِ التَّطَوُّعِ لَا الْمَكْتُوبَةَ وَجَمِيعَ التَّطَوُّعِThe chapter on the evidence that the Prophet only meant some voluntary prayers, not obligatory or all voluntary prayers, by his prohibition after Fajr and Asr
Hadith 0
قَالَ أَبُو بَكْرٍ: إِخْبَارُ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «مَنْ نَسِيَ صَلَاةً، فَلْيُصَلِّهَا إِذَا ذَكَرَهَا» دَالَّةٌ، وَإِجْمَاعُ الْمُسْلِمِينَ جَمِيعًا عَلَى أَنَّ النَّاسِيَ إِذَا نَسِيَ صَلَاةً مَكْتُوبَةً، فَذَكَرَهَا بَعْدَ الصُّبْحِ أَوْ بَعْدَ الْعَصْرِ، أَنَّ عَلَيْهِ أَنْ يُصَلِّيَهَا قَبْلَ طُلُوعِ الشَّمْسِ إِنْ ذَكَرَهَا بَعْدَ الصُّبْحِ، وَقَبْلَ غُرُوبِ الشَّمْسِ إِنْ ذَكَرَهَا بَعْدَ الْعَصْرِ؛ لِأَنَّ «النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا نَهَى عَنِ التَّطَوُّعِ بَعْدَ الصُّبْحِ قَبْلَ طُلُوعِ الشَّمْسِ، وَبَعْدَ الْعَصْرِ قَبْلَ غُرُوبِ الشَّمْسِ» ، إِذْ لَوْ كَانَ نَهْيُهُ عَنْ جَمِيعِ الصَّلَاةِ فَرْضِهَا وَتَطَوُّعِهَا لَمْ يَجُزْ أَنْ تُصَلَّى فَرِيضَةٌ بَعْدَ الصُّبْحِ قَبْلَ طُلُوعِ الشَّمْسِ، وَلَا بَعْدَ الْعَصْرِ قَبْلَ غُرُوبِ الشَّمْسِ، وَإِنْ كَانَ نَاسِيًا لَهَا، فَذَكَرَهَا فِي أَحَدِ هَذَيْنِ الْوَقْتَيْنِ، وَالدَّلِيلُ الثَّانِي أَنَّهُ إِنَّمَا أَرَادَ بَعْضَ التَّطَوُّعِ لَا كُلَّهَا، سَأُبَيِّنُهُ فِي مَوْضِعِهِ مِنْ هَذَا الْكِتَابِ إِنْ شَاءَ اللَّهُ
Abu Bakr said: The report of the Prophet, peace and blessings be upon him: «مَنْ نَسِيَ صَلَاةً، فَلْيُصَلِّهَا إِذَا ذَكَرَهَا» is an indication, and the consensus of all the Muslims is that if someone forgets an obligatory prayer, and then remembers it after Fajr or after Asr, it is incumbent upon him to perform it before sunrise if he remembers it after Fajr, and before sunset if he remembers it after Asr; because «النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا نَهَى عَنِ التَّطَوُّعِ بَعْدَ الصُّبْحِ قَبْلَ طُلُوعِ الشَّمْسِ، وَبَعْدَ الْعَصْرِ قَبْلَ غُرُوبِ الشَّمْسِ», for if his prohibition was regarding all prayer, both obligatory and voluntary, it would not be permissible to perform an obligatory prayer after Fajr before sunrise, nor after Asr before sunset, even if one had forgotten it and then remembered it in one of these two times. The second evidence is that he only intended some voluntary prayers, not all of them; I will clarify this in its place in this book, if Allah wills.
