Hadith 6020
أَخْبَرَنَا
مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ ، قَالَ : حَدَّثَنَا
حَرْمَلَةُ بْنُ يَحْيَى ، قَالَ : حَدَّثَنَا
ابْنُ وَهْبٍ ، قَالَ : أَخْبَرَنَا

ابْنِ شِهَابٍ ، عَنِ
ابْنِ الْمُسَيِّبِ ، عَنْ
أَبِي هُرَيْرَةَ ، قَالَ : اقْتَتَلَتِ امْرَأَتَانِ مِنْ هُذَيْلٍ ، فَرَمَتْ إِحْدَاهُمَا الأُخْرَى بِحَجَرٍ ، فَقَتَلَتْهَا وَمَا فِي بَطْنِهَا ، فَاخْتَصَمُوا إِلَى إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ دِيَةَ جَنِينِهَا غُرَّةٌ : عَبْدٌ ، أَوْ وَلِيدَةٌ ، وَقَضَى بِدِيَةِ الْمَرْأَةِ عَلَى عَاقِلَتِهَا ، وَيَرِثُهَا وَلَدُهَا وَمَنْ تَبِعَهُمْ " فَقَالَ حَمَلُ بْنُ النَّابِغَةِ : أَنَدِي يَا رَسُولَ اللَّهِ ؟ كَيْفَ أَغْرَمُ مَنْ لا أَكَلَ ، وَلا شَرِبَ ، وَلا نَطَقَ ، وَلا اسْتَهَلَّ ، فَمِثْلُ هَذَا يُطَلُّ ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّمَا هَذَا مِنْ أَحْدَاثِ الْكُهَّانِ ، مِنْ أَجْلِ سَجْعِهِ الَّذِي سَجَعَ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: Two women from the tribe of Huzail fought with each other. One of them struck the other and killed her, and also killed the child in her womb. They brought their case to the Prophet Muhammad (peace be upon him). The Prophet (peace be upon him) said: The blood money (diyah) for the child in her womb is a slave man or a slave woman, and the Prophet (peace be upon him) made the payment of the woman’s blood money obligatory upon her family. The woman’s children and other heirs become her inheritors. Upon this, Haml bin Nabighah said: O Messenger of Allah (peace be upon him)! Should I pay her blood money? How can I pay the blood money for someone who neither ate nor drank, nor spoke a word, nor cried out with a loud voice? Such blood is wasted. The Prophet (peace be upon him) said: He is speaking like the soothsayers. The Prophet (peace be upon him) said this because of the rhymed speech.
