Section on Retaliation - Ruling on livestock damaging others’ property by day or night
Hadith 6008
أَخْبَرَنَا ابْنُ قُتَيْبَةَ ، قَالَ : حَدَّثَنَا ابْنُ أَبِي السَّرِيِّ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، قَالَ : أَخْبَرَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ ، عَنْ أَبِيهِ : " أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطًا ، فَأَفْسَدَتْ فِيهِ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الأَرْضِ حَفِظَهَا بِالنَّهَارِ ، وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ " .
Sayyiduna Muhayyisa (may Allah be pleased with him) narrates: The she-camel of Sayyiduna Bara’ bin Azib (may Allah be pleased with him) entered a garden and damaged the produce there. So the Prophet (peace and blessings be upon him) ruled that it is obligatory upon the owners of the land to protect it during the day, and it is obligatory upon the owners of the livestock to protect them during the night.
