Section on Retaliation - A father is not liable for his son’s crime, nor the son for his father’s
Hadith 5995
أَخْبَرَنَا الْفَضْلُ بْنُ الْحُبَابِ الْجُمَحِيُّ ، قَالَ : حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ ، قَالَ : حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ إِيَادِ بْنِ لَقِيطٍ ، قَالَ : حَدَّثَنِي إِيَادُ بْنُ لَقِيطٍ ، عَنْ أَبِي رِمْثَةَ ، قَالَ : انْطَلَقْتُ مَعَ أَبِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَلَمَّا رَأَيْتُهُ قَالَ أَبِي : مَنْ هَذَا ؟ قُلْتُ : لا أَدْرِي ، قَالَ : هَذَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَاقْشَعْرَرْتُ حِينَ قَالَ ذَلِكَ ، وَكُنْتُ أَظُنُّ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لا يُشْبِهُ النَّاسَ ، فَإِذَا لَهُ وَفْرَةٌ بِهَا رَدْعٌ مِنْ حِنَّاءٍ ، وَعَلَيْهِ بُرْدَانِ أَخْضَرَانِ ، فَسَلَّمَ عَلَيْهِ أَبِي ، ثُمَّ أَخَذَ يُحَدِّثُنَا سَاعَةً ، قَالَ : " ابْنُكَ هَذَا ؟ " قَالَ : إِي وَرَبِّ الْكَعْبَةِ ، أَشْهَدُ بِهِ ، قَالَ : " أَمَا إِنَّ ابْنُكَ هَذَا لا يَجْنِي عَلَيْكَ ، وَلا تَجْنِي عَلَيْهِ " ، ثُمَّ قَرَأَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : لا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى سورة الأنعام آية 164 ، ثُمَّ نَظَرَ إِلَى السِّلْعَةِ الَّتِي بَيْنَ كَتِفَيْهِ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنِّي كَأَطَبِّ الرِّجَالِ ، أَلا أُعَالِجُهَا ؟ قَالَ : " طَبِيبُهَا الَّذِي خَلَقَهَا " . قَالَ أَبُو حَاتِمٍ : اسْمُ أَبِي رِمْثَةَ : رِفَاعَةُ بْنُ يَثْرِبِيٍّ التَّيْمِيُّ تَيْمُ الرَّبَابِ ، وَمَنْ قَالَ : إِنَّ أَبَا رِمْثَةَ هُوَ الْخَشْخَاشُ الْعَنْبَرِيُّ فَقَدْ وَهِمَ .
Sayyiduna Abu Rimthah (may Allah be pleased with him) narrates: I went with my father to the service of the Prophet Muhammad (peace and blessings be upon him). When I saw the Prophet (peace and blessings be upon him), my father asked: Who is this? I replied: I do not know. My father informed me: This is the Messenger of Allah. When he said this, I began to tremble. I thought that the Messenger of Allah would not look like ordinary people. The Prophet (peace and blessings be upon him) had long hair, some of which was dyed with henna. He (peace and blessings be upon him) was wearing two green sheets. My father greeted him (peace and blessings be upon him), then he (peace and blessings be upon him) conversed with us for a while. Then he (peace and blessings be upon him) asked: Is this your son? My father replied: Yes, by the Lord of the Ka'bah, I testify to this. The Prophet (peace and blessings be upon him) said: This son of yours will not bear the punishment for your crime, and you will not bear the punishment for his crime. Then the Prophet (peace and blessings be upon him) recited this verse: "No bearer of burdens will bear the burden of another." Then my father saw a slightly raised spot between the two shoulders of the Prophet (peace and blessings be upon him), so he said: O Messenger of Allah (peace and blessings be upon him)! I practice medicine; should I not treat it? The Prophet (peace and blessings be upon him) said: The One who created it will treat it.
(Imam Ibn Hibban, may Allah have mercy on him, says:) The name of Sayyiduna Abu Rimthah (may Allah be pleased with him) is Rifaa’ah bin Yathrabi Taymi. He belonged to Taym Rabaab. Whoever said that the name of Sayyiduna Abu Rimthah (may Allah be pleased with him) is Khushkhash Anbari is mistaken.
(Imam Ibn Hibban, may Allah have mercy on him, says:) The name of Sayyiduna Abu Rimthah (may Allah be pleased with him) is Rifaa’ah bin Yathrabi Taymi. He belonged to Taym Rabaab. Whoever said that the name of Sayyiduna Abu Rimthah (may Allah be pleased with him) is Khushkhash Anbari is mistaken.
