Section on Crimes - Denial of faith for one who kills a Muslim without right
Hadith 5979
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ ، أَخْبَرَنَا عَبْدُ الرَّزَّاقِ ، أَخْبَرَنَا مَعْمَرٌ ، عَنْ هَمَّامِ بْنِ مُنَبِّهٍ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ ، وَلا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ ، وَلا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ ، وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ ، وَلا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ إِلَيْهَا الْمُؤْمِنُونَ أَعْيُنَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ ، وَلا يَقْتُلُ أَحَدُكُمْ حِينَ يَقْتُلُ وَهُوَ مُؤْمِنٌ ، فَإِيَّاكُمْ ، إِيَّاكُمْ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) said: "A thief is not a believer while he is stealing, an adulterer is not a believer while he is committing adultery, and a person who drinks alcohol is not a believer while he is drinking alcohol. By the One in whose hand is the soul of Muhammad, whoever snatches something openly in front of people is not a believer while snatching it, and no one is a believer while killing someone. So you all should strive to avoid (all) these acts, strive to avoid them."
