ذكر البيان بأن المرتهن له ركوب الظهر إذا كان مرهونا وشرب لبن الدر إذا كانت النفقة من ناحيته-
Clarifying that the pledgee may ride or milk the mortgaged animal if he pays for its upkeep
Hadith 5935
أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ الأَزْدِيُّ ، حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، حَدَّثَنَا وَكِيعٌ ، حَدَّثَنَا زَكَرِيَّا بْنُ أَبِي زَائِدَةَ ، عَنِ الشَّعْبِيِّ ، عَنْ أَبِي هُرَيْرَةَ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " الرَّهْنُ يُرْكَبُ بِنَفَقَتِهِ ، وَلَبَنُ الدَّرِّ يُشْرَبُ إِذَا كَانَ مَرْهُونًا ، وَعَلَى الَّذِي يَرْكَبُ وَيَشْرَبُ نَفَقَتُهُ " .
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings of Allah be upon him): "The animal given as collateral may be ridden in exchange for its upkeep, and its milk may be drunk while it is held as collateral, and whoever rides or drinks its milk, its expenses will be his responsibility."
