Section on Beverages - Clarification That This Prohibition Is One of Forbiddance, Not Discipline
Hadith 5403
أَخْبَرَنَا الْحَسَنُ بْنُ سُفْيَانَ ، قَالَ : حَدَّثَنَا شَيْبَانُ بْنُ أَبِي شَيْبَةَ ، قَالَ : حَدَّثَنَا وُهَيْبٌ ، قَالَ : حَدَّثَنَا أَيُّوبُ السَّخْتِيَانِيُّ ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ ، قَالَ : كُنْتُ عِنْدَ ابْنِ عُمَرَ ، إِذْ سَأَلَهُ رَجُلٌ عَنْ نَبِيذِ الْجَرِّ ، فَقَالَ : " ذَلِكَ مِمَّا حَرَّمَ اللَّهُ وَرَسُولُهُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " ، قَالَ : فَأَتَيْتُ ابْنَ عَبَّاسٍ ، فَقُلْتُ لَهُ : إِنَّ ابْنَ عُمَرَ سُئِلَ عَنْ نَبِيذِ الْجَرِّ ، فَقَالَ : ذَلِكَ مِمَّا حَرَّمَ اللَّهُ وَرَسُولُهُ ، فَقَالَ ابْنُ عَبَّاسٍ : صَدَقَ ، فَقُلْتُ : وَمَا الْجَرُّ ؟ قَالَ : كُلُّ شَيْءٍ مِنْ مَدَرٍ .
Saeed bin Jubair narrates: I was present with Sayyiduna Abdullah bin Umar (may Allah be pleased with them). A man asked him about the nabidh (fermented drink) of a pitcher, so he replied: This is something which Allah and His Messenger (peace be upon him) have declared haram. The narrator says: Then I went to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) and I informed him that Sayyiduna Abdullah bin Umar (may Allah be pleased with them) was asked about the nabidh of a pitcher, and he replied: This is something which Allah and His Messenger have declared haram. So Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) said: He has spoken the truth. I asked: What is meant by a pitcher? He replied: Anything that is made from clay.
