ذكر الزجر عن استكراء المرء الأرض ببعض ما يخرج منها إذا كان ذلك على شرط مجهول-
Warning against renting land for a share of its produce if the terms are unknown
Hadith 5192
أَخْبَرَنَا الْحُسَيْنُ بْنُ عَبْدِ اللَّهِ الْقَطَّانُ بِالرَّقَّةَ ، قَالَ : حَدَّثَنَا حَكِيمُ بْنُ سَيْفٍ الرَّقِّيُّ ، قَالَ : حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عَمْرٍو ، عَنْ زَيْدِ بْنِ أَبِي أُنَيْسَةَ ، عَنْ أَبِي الْوَلِيدِ الْمَكِّيِّ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ : " أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَالْمُخَابَرَةِ وَأَنْ يُبَاعَ النَّخْلُ حَتَّى يُشْقِحَ " ، وَالإِشْقَاحُ : أَنْ تَحْمَرَّ أَوْ تَصْفَرَّ أَوْ يُطْعَمَ مِنْهُ شَيْءٌ ، قَالَ زَيْدٌ : فَقُلْتُ لِعَطَاءٍ : أَسَمِعْتَ هَذَا مِنْ جَابِرِ بْنِ عَبْدِ اللَّهِ ذَكَرَهُ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : نَعَمْ ، قَالَ أَبُو حَاتِمٍ : أَبُو الْوَلِيدِ هَذَا اسْمُهُ سَعِيدُ بْنُ مِينَاءَ الْمَكِّيُّ .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates: The Prophet (peace and blessings of Allah be upon him) forbade Muhaqala, Muzabana, and Mukhabara, and forbade selling the fruit of date palms until it becomes ripe. And by "ripe" it is meant: it becomes red or yellow, or fit for eating. The narrator named Zaid says: I asked Ata: Did you hear this directly from Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them), that he mentioned this hadith from the Prophet (peace and blessings of Allah be upon him)? He replied: Yes.
