ذكر خبر ثالث يصرح بأن قوله صلى الله عليه وسلم أو ليزرعها أراد به الزجر عن المخابرة التي تكون بشرائط مجهولة فندب إلى المنيحة من أجلها-
Third report clarifying that “or let him plant it” refers to discouraging sharecropping with unknown conditions, thus recommending lending instead
Hadith 5191
أَخْبَرَنَا ابْنُ سَلْمٍ ، قَالَ : حَدَّثَنَا عَبْدُ الرَّحْمَنِ ، حَدَّثَنَا الْوَلِيدُ ، قَالَ : حَدَّثَنَا الأَوْزَاعِيُّ ، قَالَ : حَدَّثَنِي أَبُو النَّجَاشِيِّ ، أَنَّهُ سَمِعَ رَافِعَ بْنَ خَدِيجٍ يُحَدِّثُ ، عَنْ عَمِّهِ ظُهَيْرِ بْنِ رَافِعٍ ، قَالَ : نَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ أَمْرٍ كَانَ لَنَا مُوَافِقًا ، فَقُلْتُ : مَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَهُوَ حَقٌّ ، فَقَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَا تَصْنَعُونَ بِمَحَاقِلِكُمْ ؟ " قُلْنَا : نُؤَاجِرُهَا عَلَى الثُّلُثِ وَالرُّبُعِ وَالأَوْسُقِ مِنَ الْبُرِّ وَالشَّعِيرِ ، قَالَ : " فَلا تَفْعَلُوا ازْرَعُوهَا أَوْ أَزْرِعُوهَا " ، قَالَ أَبُو حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ : أَبُو النَّجَاشِيِّ اسْمُهُ عَطَاءُ بْنُ صُهَيْبٍ مَوْلَى رَافِعِ بْنِ خَدِيجٍ .
Sayyiduna Zuhair bin Rafi’ (may Allah be pleased with him) narrates: The Prophet (peace and blessings of Allah be upon him) forbade us from something that was agreeable to us, so I thought that whatever the Prophet (peace and blessings of Allah be upon him) has said is the truth. He informed: The Prophet (peace and blessings of Allah be upon him) said: “What method do you adopt regarding your fields?” We replied: We lease them out for a third or a quarter of the produce, or for a specified wasq of wheat or barley. The Prophet (peace and blessings of Allah be upon him) said: “Do not do so. Either cultivate it yourself or give it to someone else to cultivate.”
(Imam Ibn Hibban, may Allah have mercy on him, says:) The narrator named Abu Najashi is ‘Ata bin Suhaib, and he is the freed slave of Sayyiduna Rafi’ bin Khadij.
